Zynga is a bully. A while back they threatened to sue the group responsible for mwap and had to close down the forum. But they're underground now and mwap rebirth is back and a lot better autoplayer.:pirate:

Zynga should be happy. Everyone would have stop playing farmvile if it wasn't for automation. Most of my friends have stopped because they don't have hour to manually click to farm. Some people are stupid and too greedy. They don't see the big picture

Including a trademarked name in a URL is a pretty likely way to get a chance to give it away. Just the way intellectual law works. It might seem like "bullying" but bottom line if a company doesnt defend their trademark they're asking for trouble.

If you ever have someone doing a trademark infringement on one YOU own, you'll be glad the laws exist. Been there, done that.

Well, not being an attorney nor a party to the suit I cant tell you for sure... but likely on the same grounds the creator of the Harry Potter series used to go after a fansite that was making money from her product. Doubt seriously any of the stuff those sites are about is currently considered "in the public domain", and using someone else's copyrighted products or characters as an income producing property can land a fella in court. Disney has been nailing people for the same thing since before the internet.

Any recent updates on this ? You cant be sued purely for writing a guide on a product without the product owners permission surely ? Copyright doesnt pertain to educational purposes...

24K is right, if anything it would be a Trademark infraction because of the name and pictures. DEFINITELY can't sue them for copyright because the guides are not copying anything written by Zynga, and it can't be a patent violation because the guide isn't an application.

I am sure if anything the guides HELPED Zynga, not hurt them. They are being idiots in my opinion.

If you want to learn more about Trademarks, Copyrights, and patents I wrote this this morning:

Copyright law is irrelevant in this case, zynga is simply hoping that with enough harassment 85% of people will voluntarily shut down their website. It's a popular tactic by lawyers in the Intellectual Property field.

The threats must be working, farmvillemillionaire.com now redirects directly to farmville.com.
What I do not understand is how can they sue for using the name farmville, when there is a farmville va. I understand the difference that one is an app and one is a city, but how can they claim ownership to farmville when that name was previously taken by farmville virginia?

What I'm wondering is whether any of the defendants will appear in court.

If none of the defendants appear in court, wouldn't the court provide default judgment for the plaintiff (Zynga wins automatically?).

Are we sure it's the NAME "Farmville" that is at the root of the copyright infringment case? Perhaps the guides are using unauthorised screenshots of the game itself, which I imagine would be subject to copyright. Just a thought...

These lawsuits are called: Dont piss us off, or we will throw a big bag at you, and you need to fill it up with money.

    Basically these guys are fucked.

And to whoever said..."Bite me". Just wait till you get sued by someone with deep pockets one day. You'll have a deeper insight of what "bite me" can actually mean :)

    Yeah,

Just curious, can Zynga really sue the Sellers of the ebooks, not just the makers, and win?

Zynga is suing Joshua Mintz because he owns and operates:
    mafiawarsfacebookcheatcode.com, farmvillefacebookgamecheats.info and
    cafeworldfacebookcheats.info.

He's a seller not maker of the ebook.

This is from the link http://www.rfcexpress.com/lawsuit.asp?id=54558

4/27/2010 14 CERTIFICATE OF SERVICE by Zynga Game Network, Inc. re 5 Summons Issued, 1 Complaint,, Proof of Service of the Summons and Complaint and Initiating Documents on Defendant Joshua Mintz (Wilson, Dennis) (Filed on 4/27/2010) (Entered: 04/27/2010)

Do you sue Heckler & Koch for producing guns or do you sue the policeman who shot the fat woman in the supermarket because she didn't want to drop what appeared to be a large sandwich?

I would imagine Mr. Mintz is getting sued because he didn't comply with the cease and desist order - His sites are still operational. I noticed that many of the review sites that are now redirecting to parked pages aren't turning up in this lawsuit.

I find it quite alarming that Mr. Sanders is still operating an affiliate section that promotes the use of trademarked images. Unfortunately, anyone getting involved with the fvsecrets product might get their first taste of a trademark infringement/anti-cybersquatting c/d.
