Anyone see this case where Yelp is suing sites selling fake review sites?
I have seen a recent trend here on BHW and other forums where review selling sites are complaining of receiving cease and desist letters from these sites, like one a few weeks ago where a member here received a letter from Facebooks lawyers.
Looks like we might be having a new trend by this companies where they are fighting back.
    Be careful guys.
Host your site offshore and be extra vigilant, dropping the soap in prison isn't as funny when you are in.

Interesting, I had a similar business idea some time back. I discarded it because I figured it was extortion. Now the 9th circuit is giving me the green light.

Anyone know if Court of Appeals rulings can be used as case law in a defense?

Defendants in civil lawsuits don't get sent to jail unless they do something idiotic are in contempt of court. The punishment for breaking a contract with Yelp isn't loss of freedom and anal rape.

Even not paying a judgement doesn't automatically mean jail time.

Their goal is to try to make examples out of a few in order to get people running.

They are probably just doing it to make it seem like they are serious on cracking down on fake reviews, so people continue to trust yelp for finding out how good a business is.

If indeed a contract can be demonstrated to have existed in the first place. And thats where they run into issues.

If I'm not a yelp user, I'm not bound by anything they say.

And, if I was running defense in a civil suit against someone being sued for selling yelp reviews, I would have an absolute field day making yelp look bad just based on their business model of quasi-extortion. And in civil suits, looks DO matter. Its basically just a pooularity contest.
