xRumer Illegal to Use!?

    Hey. I was recently searching for my website in google to see how well xrumer spammed it, and I found my IP address and two websites I spammed on projecthoneypot.org! The first paragraph read:

    The Project Honey Pot system has detected behavior from the IP address consistent with that of a comment spammer. Below we've reported some other data associated with this IP. This interrelated data helps map spammers' networks and aids in law enforcement efforts. If you know something about this IP, please leave a comment.
    wtf!?!?! "aids in law enforcement efforts"? Is spamming with xrumer illegal?

    lol...well it worked in the sense that it scared you :)

    I'm not a lawyer but I don't think that there is anything that anyone can do about this sort of thing unless they can prove damages (usually financial).

    Haha this is a great thread, spam is illegal. Yes using some automated program to spam the fuck out of forums could be considered unauthorized use of their servers.

    actually, spam ISNT illegal. It is only illegal if it is bulk email spam with false return addresses or misleading subject lines. The only other way its illegal is if its promoting an illegal product or (not so sure about this one) causes monetary damage. Spamming forums is completely legal. Just search google and you'll get more detailed info.

    Spam is illegal when:
    - In mail with no end-subscription link
    - Illegal stuff
    - False e-mailadres
    - Spoofed e-mailadres
    - Usage of illegal tricks to enforce the target to encourage buying something (spyware)
    - Usage of exploits to make backlinks

    Spam is legal when:
    - Spammed on boards/forums/comment systems
    - Spammed on websites with legal tricks (no exploits w/e)

    Just because there is no specific law against forum spam does not mean that you cannot be charged with a crime.

    wtf... that sucks. I'm pretty sure he wouldn't have gotten arrested if he just kept to himself and boosted some of his own sites, but putting the president's site to #1 for the search term penis isn't something the government will like :p It's still amazing that he was able to write a script to get you to the first place on google, if only we coulda gotten our hands on that when it was still functional :p

    MISCHIEF / Mischief in relation to data

    Section 430

    (1.1) Every one who commits mischief who willfully

    (a) destroy or alters data;

    (b) renders data meaningless, useless or ineffective;

    (c) obstructs, interrupts or interferes with the lawful use of data; or

    (d) obstructs, interrupts or interferes with any person in the lawful use of data or denies access to data to an person who is entitled to access thereto.

    (5) Everyone who commits mischief in relation to data

    (a) is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years; or

    (b) is guilty of an offence punishable on summary conviction.



    I think a good prosecutor could put you in jail if you use xrumer to take over a forum like I have seen many times. The whole first 2-3 pages are nothing but xrumer spam.

    You aren't going to jail for ruining some kid's website with link spam. Do you realize how hard it is to prove someone is guilty of this? If people were going to jail for this, you would have a whole section set up for it here on BHW. You start causing people to lose major dollars and then you might see some action taken. Until then, scrub your list the best you can, keep your proxies updated and keep submitting.

    this is just like hacking. THOUSANDS of websites get hacked a day, and many reported. The government doesn't give a shit about most of them though - it would be impossible to do so. They only go for the big ones, like people who steal credit cards or make huge botnets. If you just spam your link to forums you're fine, they're not going to hunt you down for something so small because they have serious crimes to investigate (not to mention spamming on forums isn't even a crime...), and the owner of the website will definetely not even consider sueing you because of the amazing amount of hassle and money it takes while all he has to do is hit "delete". Also, about these laws:

    (c) obstructs, interrupts or interferes with the lawful use of data; or

    (d) obstructs, interrupts or interferes with any person in the lawful use of data or denies access to data to an person who is entitled to access thereto.

    you're not obstructing the use of data because its still on the website and just as easily accessible as it was before. And denying acess to the data would be consider a DDoS attack, not spam. These laws are so broad that you can interpret them in many ways, but at the same time you can counter the interpretations just as easily.

    .... most SEOs are link spammers... I can't immagine how they could tell the difference between someone using Xrummer and a SEO using their patented "white hat" link building "techniques"......
