Wondering how Fiverr isn't worried about getting sued into oblivion?

Any legal experts here? Does Fiverr fall under DCMA Safe Harbor, so if anyone complains they have to remove offending material, but otherwise they can leave it up?

I mean I see stuff like nulled software, "any WSO for $5", just recently I saw a gig that would sell you all Elegant Themes for $5 - I know this clearly violates copyright, Elegant Themes does not sell any licences that allow reselling.

I mean, I'm just waiting for the hookers and blow gigs to start popping up (wonder how much blow I can score for $5).

    What's the deal here?

I've been wondering that as well, I've seen loads of pirated ebooks and software for sale on fiverr, I wondered how much people would make from that before they're removed

I feel that the End is Neigh for Ol' Fiverr. Sooner or later, what with all the spamming and the Ebooks and the Blackhat SEO services, somebody's gonna say SOMETHING and non of us will like it. >.<

I mean they just got Series A from Bessemer Venture Partners a month ago. VCs don't go around handing people millions if they at all feel the startup's business model is flawed from a legal standpoint, they must have checked that out.

Selling BHSEO services is not illegal, but selling pirated digital goods clearly is. If Fiverr takes a cut from it I fail to see how they can be protected by Safe Harbor? We need a legal expert on IP to chime in on this.

I will not be surprised to see them tight up on a lot of the violations. If they do not it could be Adios Amigos.

Of late, there seems to be a good amount of Fiverr animosity brewing on this forum and around the Internet.

    http://lmgtfy.com/?q=fiverr+banned+my+account

From what I gather it is due to sellers having their accounts banned and funds being frozen and held. Could that issue be correlated to what they are selling such as the Elegant Themese, WSOs, etc? Is there a way to tell if they have been reported?
