I created a XML Sitemap, which is Link from a footer Link to.

Structure of the Site is like
    frontpage
    -climbing gear-
    --best climbing gear
    --cheap climbing gear

    and so on..

Checking the site with serveral SEO tools, xml sitemap seems to NOT cause any trouble.

however, as from your perspective, would you recommend to remove the footer link to the xml sitemap? to keep more internal link juice? to not cause any problems with silo structure?

my worries are, that creating a xml sitemap (which links to the articles then in it self) will create a flat structure, where:

    frontpage
    -climbing gear-
    -best climbing gear
    -cheap climbing gear
    etc.

    are all Tier 1 then

just remove it from the footer, why you want it there? I thought u are supposed to submit sitemap in webmaster tools if you must to help google index your site right? - But ur site should index properly without any sitemap if it has good link profile, right?
