Will a DMCA Disclaimer cover my website?

    If your website is using images and videos from other sources will a DMCA disclaimer protect me or not?

    If you are using copyrighted/trademarked material, then no.

    However, there is a fair use exception to the DMCA. You can use this by comparing two products such as the features of a Timex watch against an Invitca watch. Of course you are marketing the Timex. You can also use short excerpts of movies and music in the same way. With music you can also add, such as lyrics for the video, or alter them, or make a comparison of two songs. However, with music, you sometime run into fanatical artists such as Santana or Prince, that object to any use of their material and will issue a false DMCA complaint.

    I would suggest that you read all the material you can find on the Digital Millennium Copyright Act because there are several things that must be done and several thing that can be done to nullify a complaint.
