why is 'news' video an exception in youtube partnership?

    The Youtube partnership program does not entertain copyrighted content, like videos, music and footage of which you do not have worldwide distribution rights. However, news content be it the death of Gadaffir or the Marco's death, these are uploaded by people and they still get ads..so how does this work? Is the news related vids an exception?

    A couple things are happening here:

    Many of these videos are uploaded by the original producers.
    Also, news is a bit of a fuzzy fair use area, "commentary" is an exemption in the law and news content posted under certain circumstances is commentary.
