In the best case scenario you should make all your content unique if you want to rank high in Google for your chosen keywords.
Other ways your site can be penalised are:
- Linking too fast
- Linking from spammy sites
There are many others that I'm sure some people will chime in on.
Remember that Google doesn't want you to be building links at all. They want them to come naturally. They are obviously living in cuckoo fairy tale land where you fart and rainbows come out.

You are probably using other content and Google knows
You need to write all unique content - and start it off the right way

It all depends on how you were penalised?
Spam penalty?
Unnatural links penalty?
duplicate contents penalty?
you can only understand why you were penalised if you check google webmaster tools to see.
although i don't like to put any sites through Webmaster tools i will eventually add them if i suspect a penalty.
