What Happens If Someone Buys And I Don't Ship, on Ebay?
That is listed as fraud and violated eBay's TOS. They could potentially sue you for their money back. It's NOT a good situation and I wouldn't recommend it to anyone, you are breaking the law and could get in a large heap of trouble, don't do it.
It would help to know the exact situation. If you don't have the item, email the winner and say something along the lines of "I'm sorry, but the item you won was sold in my store and is now unavailable. I can refund your money or you can wait (x amount of days) until our next shipment arrives." Most people will be fine with a refund and not complain. If the auction didn't finish as high as you would have liked it to, then your out of luck. If you are not shipping it because of this beware. Consequences follow.
Someone can easily open a claim on PayPal and get refund..
Not a Good Business Model, Just think if someone do it to you.

they could file a dispute on paypal or ebay. you might get lucky and they dont do anything about it

If they paid via paypal, I believe paypal will sieze the money in your account and refund it to them. Ebay have a great system in place for getting refunds to screwed over buyers.
Depends on the country you are living. I am pretty sure e.g. in whole Europe and US this is just fraud. Prison. Hopefully a head shoot.
I personally would try to find out your address and cut your eggs while you are sleeping.
IM means being a clever boy/girl and eventually touching immoral areas but definitely not committing crimes.
You don't go to prison unless you steal something like thousands of dollars, I'm sure. I've been involved in a lot of online trading and watched people get screwed over my hundreds of US dollars. Department of Security or whatever at least in the States does nothing; this sort of theift is much harder to chase.
However, you're still a jerk. If you did it enough, you'd get chased after eventually.
We're on a Black Hat Forum, so our morals are clearly somewhat skewed, but lets not just degenerate altogether

Neg feedback followed by Gaypal dispute, possible suspension of egay account - the list goes on and that's before any law enforcement get involved.
There's been a few who ended up in the big house as they thought it was easy money. It just ain't worth the hassle irrespective of the amount.
-They will open an eBay claim and get their money back.
-You'll get negative feedback
-eBay might ban your account or limit it.

That happened to me once because the person finally paid after a case was open. I refused to send the item because of their nasty comments to me. They opened a case, I showed eBay the communication. I refunded the money and eBay removed the negative feedback the person left for me.
they can open a claim and they can file a chargeback with their bank and this will result in a negative $10 in your account. and if you don't pay that negative $10, paypal will send legal letters to you.
I've done this before in the past. At times, I just got really lazy and just didn't want to follow through.
My account is still there. They file a report, eBay/Paypal refunds their money after you don't have a rebuttel with shipping confirmation (signed required for over $200). Nothing bad happened other than a case that gets logged. They didn't have minimum/maximum number of allowed cases several years ago.
Oh, also I got negged on my feedback. It's Ok, I have like over a thousand reviews so it's less than like 1% where this happened.
If you do it long enough . You would end up in a cell next to a guy called bubba !_!
