i know of a very untapped niche that people are searching for. i have an ebook in mind that i would like to write that caters to this niche. what are the possible pitfalls of writing something that is highly, highly, highly illegal? i know i can put disclaimers and stuff, but should i still be worried?

Well you have freedom of speech/press, however if somebody acts out something illegal in your ebook (which is essentially the point) you could probably get in trouble for facilitating the illegal act.

    Hope this helps.

I believe that if you have a VERY detailed disclosure, you should be fine. Freedom of speech/press is absolutely on your side. You just need to make sure that not only your disclosure, but also the writing itself, doesn't imply or condone the illegal act.

I can write an informational ebook on how to build a bomb....but my disclaimer would have to say don't do this, this is illegal, this is for informational purposes and/or entertainment purposes only, I don't personally do this, I don't personally condone this, should you choose to do this you are breaking the law, you should not use this book to break the law, etc, etc, etc.

thanks for the replies. there's a few sub niches in this area too. nobody seems to be monetizing it though. i may just have to consult with my atty. to write up an effective disclaimer. if i even decide to go that route.

There was a book written several years ago called "Hitman" (Not the same as the recent movie). It was published by Paladin Press, which is an underground book company.

The book was basically a textbook explaining in painstaking detail how to kill someone and get away with it. It was challenged in court and the publisher won.

Basically, if you include the disclaimer that your book is "For Entertainment Purposes Only", you should not have any legal difficulty. Note: I am not a legal expert, therefore I cannot state for certain that what I have said above is completely applicable in the present.

    "Wiz"

Freedom of speech laws do protect you...but only if you take proper precautions. Your best bet is to consult with an attorney. Ask for a free consult...most will agree. At the very least you will prob need the attorney to draft the "disclaimers" so that you are 100% legal and covered should someone actually get caught using the methods you outlined and implicate you.

you can't unring a bell - once info is out there, it's out there... for good!
and 'freedom of the press' no longer holds up in court.

and keep in mind the current climate we are living in.

before 9/11, subversive info got a pass. now it can put you on a list that
    will never be erased.

here's a question, how much is a good night's sleep worth to you?
