What are the legal ramifications of...

    Hey,

    I might build an insanely awesome forum. Here's my business model:

    Free Membership
    Paid Membership gets access to a sales thread and locked forum (just like bhw)
    Forum Ads

    Here's my question: Can I put programs in the locked forum? For instance with the dating niche, could I take somebody's program and release it in that section free of charge?

    I think this get's hazy because I'd be charging them to get access to that level of the forum

    so you want to crack software and add it to a paid site? i'd be careful with selling illegal copies

    Just a heads up for the future. If you ask a legal question then include as many details as possible.
    For example "somebody's program" is quite a loose term here. Who is "somebody" and have they provided you with any rights to share their product?



    Anyways I'm no lawyer but I, unlike certain individuals, possess a degree of common sense.
    As a broad answer, you cannot share the software if the software license does not allow you to do so.
    Certain software licenses permit a third party to modify, share, resell or even rebrand the product while others are very prohibitive.
    If no license has been explicitly stated for a given piece of software then naturally you cannot share it.

    My opinion:
    Your idea is neither awesome nor unique. There exists countless forums with identical "business models" and only the large players are actually making money.
    If you really do wish to pursuit your "awesome" idea then obviously you're going to need at least bulletproof hosting.

    The only way to be not completely illegal is to do it like on BHW. You yourself cannot share it, you can provide a section (paid or not doesn't matter) where OTHER users can post stuff (and don't call it a pirated shit section, let it be known its for users to share free stuff or their own stuff so any copyrighted stuff they post is their fault and not encouraged by you). Then put up your DMCA notice with good contact info and be fully DMCA compliant (remove things when people submit a DMCA request). You're now doing your part, you didn't share the copyrighted stuff and you took it down as soon as notified.

    You can of course get shady and make fake users to post this content you want, but you'll still need to remove it when asked.

    Or you can go completely black hat and just post up whatever you want and tell everyone to fuck off but you better have a host that doesn't care about DMCA complaints and you probably shouldn't live in the US if you get popular/make any real money.

    i have come across plenty of sites offering cracked software and it's a dark area to get into. as Ambassy has given you some good advice i'd save myself a lot of hassle in the future and follow that advice given. You could offer your own products and get them made for you, go on sites like iwriter and have ebooks made that are exclusive. Fiverr and BHW have wp theme designers, plugin makers etc. Commission them and keep legal

    Appreciate it. Knew there had to be a way since we do it here: I'd probably add something like that to the equivalent of the jr. exec level so I doubt there'd be many complaints- how shady is doing it under fake accounts?

    (Don't want to get into any legal trouble)

    Its up to you. Really its not something you'd have to worry about, if you happened to have great success and were making millions and you got prosecuted they'd probably subpeona records and show those accounts were fake and that doesn't look good but in real life you'd probably be just fine.

    Again though watch advertising the paid section as containing known copyrighted material or encouraging the upload of known copyright material as that can be problematic as well. You basically have to be able to say you didn't know/encourage copyrighted stuff to be shared and you comply with any DMCA notices sent to you to remove it in a timely manner.
