Website transfer to other domain, penalty still sticks?

    I am going to transfer my old website files on my old domain (which is penalized for suspicious link building) to my new domain, will there be a problem with this?

    No problem but i would ideally just build a second site with fresh new content and rank that separately if you can afford it. But do not 301 redirect the old site to the new one as it may pass on the penalty.

    I agree, no 301. If you're not putting new content, do all the changes you can and first of all delete the old content on the old website, to avoid duplicated content problems. If you make sure Google understands that the old website is gone, then you can publish the new one and I think it will look new to SEs.
