Unauthorized Use of Twentieth Century Fox Film Corporation Intellectual Property

    To Whom It May Concern: We are writing to you on behalf of Twentieth Century Fox Television Studios ("Fox"), owner of copyright, trademark and other intellectual property rights in, inter alia, the computer game THE SIMPSONS: TAPPED OUT (the "Game"), including trademark and copyright rights to the characters, images, designs, slogans, voices, and other distinctive creative elements of the Game (the "FOX IP"). It has come to our attention that you own and operate the website at http://domain.com/ (the "Infringing Website") which uses the FOX IP to offer hacks to allow users to circumvent the feature-purchasing procedures in the Game. The Infringing Website creates consumer confusion because users encountering it will assume that Fox sponsors, endorses, or authorizes the content thereon, when it in fact does not. Accordingly, the Infringing Website violates Fox's trademark rights and constitutes unfair competition under the Lanham Act. See 15 U.S.C. § 1114 and § 1025. Furthermore, your use of Fox's copyrighted images from the Game and copyrighted theme song from the television series THE SIMPSONS, on the Infringing Website constitutes copyright infringement. Such infringement entitles Fox to recover its actual damages, statutory damages up to US$150,000 per copyright infringed, your profits, Fox's attorney's fees, and court costs. See 17 U.S.C. §§502 - 505. We therefore demand that you immediately: 1. Remove all references to THE SIMPSONS and THE SIMPSONS: TAPPED OUT from http://domain.com/; all other websites that you own, control or post on; Facebook, Twitter and all other social media; advertisements; and email; 2. Cease all use, display or distribution of the FOX IP from http://domain.com/; all other websites that you own, control or post on; Facebook, Twitter and all other social media; advertisements; and email; 3. Cease all offers or attempts to hack the Game in any media or venue whatsoever, including but not limited to http://domain.com/; all other websites that you own, control or post on; Facebook, Twitter and all other social media; advertisements; and email; 4. At your own expense, assign the http://domain.com//URL to Fox; 5. Identify the total revenue thathttp://domain.com//has generated to date, and, 6. Confirm in writing to the undersigned no later than May 29, 2014, that you shall fully and promptly comply with each of the foregoing demands. Should you fail to comply with the above demands by the close of business on May 29, 2014 we will consider taking all appropriate action against you without further notice to you. This letter is without prejudice to Fox's rights and remedies, all of which are expressly reserved. What you guys think? I already removed all content on this domain

    that's the reason you should have a whois protection and for such kind of sites use some hosting that have "DMCA Ignored" tag. :D

    First check the email address of the sender. If it's real deal then goodbye. I never had this issue since 3 years stepping on internet marketing stuff although I make lot of copyrighted sites.

    It looks like a cease and desist, but I'm no attorney. They're not demanding damages, only saying that they're entitled to them. The only thing they demanded was that you remove everything immediately. As far as I can tell, that's your fair warning to stop now or else ...

    Check to ensure it's from Fox and forward it to an attorney.

    Hi, I actually work for a company that sends out letters such as the one you received. You truly have nothing to worry about as long as you removed the offending content. I agree with the others though, it is best to make sure your whois info is not public. They can still contact you using the whois info, but the difference will be that they won't have your personal info (your real address, name, email). The letter is just a warning. Since you removed the content, you're good. They aren't coming for you lol

    the letter does not seems legit to me, anyways is this site making good money? If yes then I would move it offshore or just pull the plug on the site.

    It makes me laugh when I read comments saying "make your domain information private" because Godaddy, or their company Domains by Proxy, is going to fight a legal battle on your behalf right? You did spend £8 with them right?

    Whois privacy will spare you from spam and will also mean that someone who is watching what domains you are buying or the niches the sites you are building will be unable to do so.

    Whois privacy does not mean that when Twentieth Century Fox come calling with their $2000 a hour lawyers Godaddy is going to fight the noble fight on your behalf.
