UDRP process

I just received Notification of Complaint and Commencement of Administrative Proceeding (UDRP process).

I want to respond to it as I believe I have legal rights to keep the domain.

Since it's going to be my first time doing so I want to understand two things:

1. Is there any fee on my end associated with losing the case?
2. I have downloaded a response template from the WIPO website which I want to fill out send send back. The are asking about all sensitive information there. I know I must keep the compliant on copy. Do I have to provide all my person information (name, address etc) in the response or is it as simple ending through a word doc with my statements and any appendixes ? I rather not disclose my name, address etc to the compliant..

Start by looking up on TESS for any "Live" trademark registrations and possible infringement- and you decide if you just don't respond and move on with a black mark. There are several domainers with dozen's of UDRP's against them, it's kinda incredible really. Hopefully it's not a trademark issue.

Figure out the domain market value, your possible defense legal fee's and who your opposition is, how deep their pockets are, etc. It's like $4k for the complainant to file the UDRP. There are few good attorney's who deal with these WIPO filings daily. Some trademarked domains outside your Country or "other jurisdiction" cases, etc. get really costly and you are fighting someone with unlimited legal resources- like the guy who registered and ran a business on France dot com for years and is now it a bitter fight against the Country, or Nissan, etc.

"Sensitive information" well sorry to tell you, but it is now wide open worldwide- every UDRP the privacy for registrant is unmasked so all your info is revealed, and could be indexed and you are on a list- look at UDRPsearch to see your case if already filed and read all the other complaints, their results, etc. Or go to Wipo dot INT.

Sometimes I have seen registrants who don't even respond at all and if the case is weak for the complainant, the registrant will win and retain the name.

You need to take a hard look at the monetary value of the domain name to you and to the market- not using some worthless online tools like estibot or GD estimator. Best of luck.
