Trademark Question

    Hi guys,

    Do you have an idea if something like 'Mens Health Zone' is an acceptable domain for trademark issues, if say "Mens Health" is already a trademark?

    Hm...I honestly doubt it. But I'm no lawyer haha. A quick Google search of "Mens Health" brings up a few sites with it in the domain, and they seem to have been around for a while. Not sure if you were just using that as an example though haha.

    I got to thinking... since the words are each common "means" and "health" I think it should be ok. Of course "xerox" xyz will not be ok, since 'xerox' is a trademark.

    At first glance I said no issues. After digging into the trademark and finding a magazine named Men's Health is the ones pushing for the trademark, I'd say stay away from it. They JUST GOT the publication number from the trademark office literally 3 days ago. Now they can enforce their trademark aggressively.

    Yes, Mens Health is a print magazine, that is why I asked that question. Probably better not to mess with it, although I think a longer phrase would not violate their copyright.

    My business was defendant in a $585,000 copyright suit in 1999. Cost me $200,000 and 4 years of headaches. I received a good lesson I'll probably never forget in copyright and trademark law.

    Your assumption about longer name is wrong. Save yourself some grief and follow your instincts.

    Sorry to hear that. Yes, better stay away. There are tons of other phrases :)
