This Guy Lawer Keeps Telling Me They Are Gonna Sue Me

    So I did some posting for this company (not gonna mention their name), and I was working on a revenue sharing model. Their company had to do with a forex trading fund, and he promised to give me 10% of any money raised from my advertising for his fund. I did get him to pay me some money up front to at least cover my cost.

    Anyways, I know I raised a bunch of money for this guy, and long story short he claimed to only owe me $1,600. I said screw it, I'll take the money and move on...no harm no fowl. Trust me after hearing this guys excuses, I was glad to just take the money and run.

    So, it takes the guy like a month and a half to pay the initial $800, and the most annoying part is I would send him an invoice, and he would say it would get paid on a certain date...the date would come, and nothing. He did this numerous times.

    The second time around was the same BS. Ten to fifteen times dude would say he was going to pay me and nothing.

    Finally this last Friday I wrote the guy a final email. I told him that if he did not make the payment, that I was going to file a complaint with all the complaint boards, and do a massive SEO campaign on his ass.

    Friday, came and went with no payment. Saturday, I submitted a complaint to Ri p Off Report, and another complaint board about this loser.

    Monday morning comes, and guess who is calling me. This guy was like just remove it and I will pay you $1600!! So, I agreed, but I know that you can not remove your complaints off these boards. I figure if he makes the payment before he finds out I am golden.

    Then he calls me again, and starts yelling at me. I was like "buddy, I gave you 2 months to pay this, and I told you what I was gonna do, if it doesn't get paid. You made your bed, now lie in it!".

    Then, I get a call from his layer, saying they are going to sue me over for defamation, over the comments.

    Does this guy have any grounds to sue me?

    What fucking balls people have.

    Just so long as you have factual evidence to back up your claims, and did not voice any opinions you are fine :D

    Btw: Make sure you record all phone conversations and ask for everything in writing.

    tell them to stuff the lawsuit up their ass. You've got proof that's all you need. My money on his "lawyer" just being a partner/friend of his. Lawyers don't threaten to sue they just do it.

    your client has the right to sue you for defamation if they can prove you damaged their reputation or good name with false information. but based on your case, you have all the proof that they never paid you. if you can prove what you say is true, chances are that you won't end up in court. their problem is that they have to prove you are making false statements against them :)

    Ya, I think you are right. He said he is a lawyer, but why would he call me?? Plus, if the guy doesn't have $800 to pay me, how is he gonna afford a lawyer??

    The problem is that it was a verbal agreement, but I do have emails from him that I saved.

    Also, in my fit of anger I mentioned another fund that he is involved with, and the way I worded it in the complaint made it look like the fund was a scam, when I didn't mean it that way.

    A little tip here. Lawyers are about making money. This means two things, billable hours or a percentage. No lawyer in their right mind is going to just call you and tell you to stop, what does he make on that 10 minutes of billable time plus MAYBE some discovery that he throws in. He is going to at least file against you and get a few consults in with his client plus maybe a meeting or two with the both of you so that he can charge a couple grand, this is not real.

    Dude I would send them a demand letter certified mail.. Demanding that they leave you the fook alone. They can't do anything unless what you reported was fact.

    Similar situation happend to me. Only I lost in court - then I appealed it to the State and won... If you are in teh right you won't loose just don't let them bully you.

    Ya, I could do a lot more to ruin this guy, but at this point I think being truthful is all that matters. No reason to take it any further, unless he does sue me. Then I will go ape shit on his ass.

    The thing is, I am a good guy. I don't like doing this shit, but this guy was given plenty of time to pay me, and I was nice about it to the point where I felt like I was getting jerked around, and taken advantage of.

    From what I am gathering from all of my research is that it is really hard to prove that I even posted the complaint, so at this point I just have to be careful not to incriminate myself.

    Those who use the most threatening word "sue" usually are just talk. I know this because I use to work in a law firm awhile back. If they really want to take further action, they will not try and scare you with saying they will sue you. They will try and make you even more by confronting you with a more professional matter, calmed like they are so confident they will win, and letting you know that they will see you in court and see what the courts have to say about it.

    No lawyer, a tleast not good one will threaten the offender by saying they will sue you.

    Here is the latest emails from this guy. He is acting like he is CCing to his lawyer. BTW- I did sign a contract with them. I just found it. Forgot about that.

    He is also planning on contacting Google Checkout and Paypal saying I extorted him.

    If you got evidence and he is saying that he is going to sue you and such, why don't you just sue him and get your full amount? It would save a lot of time and BS.

    OR

    Do you have a friend that is a lawyer or knows alot about this kind of stuff? :) Because you can get people's IP address through msn and other places/ways. So if you did this, you could do a whois search, find his address, real name, phone number and so on... That is if you don't already know it. Then you can give him a call/send him some mail saying that he is being sued or somethin like that.

    I would just gather up all information about you're contract and business that was done/paid/not paid for and take him to court.. This guy just seems like a douche acting like he has the upper-hand. If you have evidence in written to back you're claim against him, just work from there..

    Get the paper work ready. I would give him one last attempt to settle his debt with you, just make sure this is mailed/copied asap and either sent by a lawyer or yourself. Just one more piece of evidence that you can use..

    I would consider small courts. There are no lawyers allowed there, hence his fancy suit dummy lawyer won't be able to be present. Although if he were to sue you for slander that would be a different story.

    This guy is blowing smoke up your ass. I doubt that was a lawyer calling you. Lawyers don't normally call people they plan on suing. They would send you a certified letter because they have to prove in a court of law that they attempted to contact you for a settlement.

    Also, don't recant your statements and complaints you made until he pays up. If you do, he will never pay what he owes you. If he takes you to small claims court you will most likely end up winning because he's the one who owes you money.

    Just make sure that you keep all of the emails and if it's legal where you are to record conversations, then do so. If he leaves you voicemails, make sure you keep a copy of them all.

    Whatever you do, don't back down.
