    I'd argue that the identity I portrayed to be was ficticious.
    Therefore I wasn't Impersonating a person.

    that's for people who impersonate famous people like celeb, not for ewhore. also, that bill is in california only. if you're not in california nor in us, it would be ok.

    so assuming the character or appearance of anybody that is not you online is what you're using to ewhore... hmmm

    I think the point of the law in large part is to prevent people portraying themselves as another living person. Most likely they'll only pursue this in cases where someone is impersonating someone else so as to cause them some type of harm. Such as impersonating a celebrity to imply that they're endorsing you or a product your selling or an idea your promoting. Impersonating some other real person in order to somehow hurt their reputations. Impersonating another real person in order to perpetrate some type of scam. That last part might give them some leeway if they wanted to go after ewhoring, but it's more likely they'll only use it in cases where there is actually some type of damages associated with the act. If you act like some girl and get a guy to send you a $1000 to buy a plane ticket so the fake girl can come visit then they'll probably be more likely to add this in if they were to prosecute. If you create a female profile and promote a legitimate product being sold online then it's most likely this new law won't be a problem.

    I'm not an expert of course so this is just my opinion. It surely can't be all inclusive though because it's a very common practice for authors to create pen names for their published works. Musicians and singers like to create catchy names and interesting backstories. And in Hollywood, the SAG makes it mandatory for actors to choose names that haven't been used by other actors. If your reall name really was Lee Majors you wouldn't be allowed to use that name in any Hollywood movies because Harvey Yeary already chose that name for himself.

    If they were to make it such a blanket law then it would actually make it illegal for anyone to use a pseudonym, pen name, nome de plume, or any type of fictitious identity. If they took the law that literally then any author, actor, singer, musician, etc. could be prosecuted for creating a new persona for their careers.

    haha greywolf, you give the govt / legislation too much credit that they won't use it against citizens in ways that'll fuck them over.
    Free speech issues, including satire and parody (remember http://twitter.com/#!/bpglobalpr ;) ), aren't addressed in the text of the bill. So while that'll probably be fixed later (actually i think this bill will die anyways, seems unconstitutional) pennnames have nothing to do with it.

It's not so much that I think the gov't won't try to use things like this legislation to fuck people over, I just think there are too many lawyers that will be representing the defendants interests that they'll only be able to use it when it really is appropriate. Things like that cheerleader's mom a few years ago that made a fake online bf for her daughters rival, maintained a fake online romance with her just so she could destroy the girls confidence by making the fake bf dump her. In that case the rival girl killed herself over it. Pretty stupid of course, but that mom should have had more sense than that, and there really should be some kind of law addressing that. There's already laws in place that can address impersonating celebrities to make fake endorsements and testimonials, but I imagine this is just to give them one more tool to combat that as well.

    I think the key element is in regards for schemes to defraud, extort, and other scams like that. As you say they already have existing laws for that but the gov't likes to have an arsenal so to speak. Like I said we'll just have to see how it all pans out.
