So how did he get around the whole copyright - using zune in the name - thing? I know we've all received a notice at one time or another, a cease and desist email or 2...

I'm pretty sure he got around copyright because he wasn't selling anything, just discussing it. That's like apple taking down all of the forums that discuss their products, not in their best interest.

These kind of forums are usually a good thing for the company. If you were abusing their service or promoting competition then they would get you shut down.

That's not true. They can get it closed down if they like.

Generally, forums/fan sites tend to be ignored by the copyright holders as they are generally beneficial for the brand and free advertising. Doesn't mean they can't be shut down if they wanted to though.

it's free advertising for the company even if they are selling something as long as it's their product they probably won't give a shit just more money for them

It doesn't really matter if your selling anything or not. If your using a trademarked name in your domain, the company can file a claim infringement against the mark being used. In this case, the company didn't know about it or didn't care to pursue it.

Oh lol, I frequent that site. Didn't know it was operated by an IM 15 year old pimp.

Meh, should have talked business with him >_>

What he said. Plus lawyer fees would be way more tha 62,000 if the person decided to go to court. And the bad PR of MS taking down a forum may make Zune lose way more than 62,000.

Nice to read, though I will still proceed with caution. I own many exact 2 word KW domains in a specific sporting industry that could rank very well and get over 50k exact keyword searches a month... however I havent proceeded on them because of not wanting to deal with a cease and desist issue.

Maybe I will take the high road and just put up blogs that talk nothing but good about them... Put up favourable reviews ect..

    Not a bad idea actually...

Maybe amazon or ebay ads.... may even be a good idea to strictly advert some cpa..

Theres my new project for the next 3 months!

People talking about trademarked domain names, if they could take it down, ebaysucks.com and paypalsucks.com would be the first ones to go down.

So I'm sure he is more talented than me, and I am jealous. Just avoiding the obvious criticisms I'll get for this. I'm just inclined to think he got lucky. I mean, is there something I didn't read carefully enough or don't know? He sold a $1000 a month site for $62,000. A site that has more revenue potential. I wonder what he could have actually got for it if sold properly.
