SMS Marketing Laws

    Hi does somebody know what the US law is saying about SMS Marketing ?

    What would happen if i scrape targeted numbers and send them an offer based on their postings/requests ?


    Would there be any issues to send 100k sms at once?

    There are strict laws actually.


    • All contacts on your client's list must have given explicit consent to send "text messages" to them. This consent can either be verbal or written, more preferably written. When getting written permission, the contact must understand:
    1) They will be receiving texts and
    2) message and data rates may apply.

    This is a regulation from the mobile marketing association that must be adhered to.

    IF you are using a platform to import lists, and you do not adhere to the rules of importing you will be fined heavily by the MMA (Mobile Marketing Association) per complain, along with other possible charges.


    It's similar to unsolicited email spam.
