Just FYI, as I don't like misinformation... GDPR still applies if you are based outside the EU but targeting EU residents as it is legislation designed (on the face of it) to protect EU citizens.

That being said, it wouldn't apply here provided this new service by SMMnet is being provided in essence by the same business and/or the terms when signing up make it clear that the information could be used in this manner.

I never said any misinformation, the GDPR does not apply to those that aren't in the EU. The USA is a sovereign nation not a member of the EU.

GDPR applies if you are based outside the EU and collecting data from someone based in the EU.

I am fairly certain anyone who offers services to or collects data from people who live in the EU or businesses established in the EU are held to GDPR standards.

So, it depends what you mean by "does not apply." Every website I have reviewed is very clear that, by their definition, GDPR does apply outside of the EU.

Just check the terms to be sure:

    Code:
    https://smm.net/terms
    Code:
By inputing your contact information anywhere on our website, you are agreeing to accept all future promotions via email, mailbox, or any other methods of choice by The Ad Genius, LLC
Now whether that terms folllows regulations is another question, but it is very clearly stated.

I'm glad some users stepped in to point that out about GDPR. I would also suggest this thread be closed. @BassTrackerBoats @MisterF I think the title is a wild accusation and given everything shared in this thread at the very least a mistake on the OP's part. I don't see any value in this thread continuing other than the healthy discussion about GDPR but that should not be under this thread and such a title at @SMMnet expense.

    Just my 2c

The EU can claim as much as they want that everyone in the world has to obey it, but in reality, if you aren't in the EU you can ignore the laws of the EU. If you had to obey the laws of every single nation rather than just your own you might as well just not do business.

You're entitled to make that statement and believe that you don't have to abide by those rules and legislations. But please in future make it clear that you are choosing to ignore that regulation, not that it does not apply, as you could give other people the wrong impression.

Whether you like it or not, GDPR applies if you are outside the EU and targeting people within the EU. What you choose to do with that knowledge is up to you.
