Selling fake brands on eBay: why is eBay cool about it?

    Hi all,

    to keep it short, there are hundreds (if not thousands) of sellers in my niche on eBay who are selling fake stuff (Nike, Puma, adidas, any sports brand, you name it).

    Obviously, these items are made in China

    Many of these sellers EXPLICITLY state that their item is a replica, an unofficial, a copy, etc...
    Many of them confess the item is made in China / Indonesia / any other Asian country
    And many of them are TOP-RATED, POWERSELLERS with THOUSANDS OF FEEDBACKS, meaning they probably sold thousands of these fake brand products on eBay over the years!

    Why isn't eBay getting rid of these guys? Although eBay states that it does not allow counterfeits, apparently little is done about it...

    On another note, is it legal to sell a copy that does NOT bear the brand logo?

    if it does not have the brand name then it is not a copy

    And what happened?

    Is it like an automatic detection, or an eBay employee went over your listing?

    Are you positive about that?

    So a pair of shoes that look exactly like Nike shoes except that they do NOT feature the Nike brand name or logo, are not legally considered to be counterfeit?
    Although, in my understanding, the design itself has a patent and is considered to be copyrighted..?

    I bought a Tissot watch that the seller claimed was 100% authentic and it was an auction. When I received it everything checked out as authentic (As I closely checked the authentic watch and the box contents in a local store before purchasing off ebay) and everything was perfect. The manuals and brochures and the gift bag everything screamed authentic but only the leather material didn't feel so.

    So I went to a local watch repair shop and showed him the watch asking him to check if this is authentic or replica. The man said "This is a good replica" the moment the watch reached his hands. He didn't even have to open the back of the watch to check the mechanical parts.

    I left a negative feedback and then reported the listing to ebay and told them about the case and they just removed the listing (which was useless for the seller anyway as I won the auction and it was closed) but they didn't ban the seller and didn't also refund me. I opened a paypal dispute then called paypal on the phone right away and told them that I'm already at the bank and asked them to check the case right now and refund or else I will immediately file charge back through the bank. They refunded immediately before I hang up.

    Long story short, Ebay is cool about it to collect some commission and make some profits.

    If this happened ebay must do action for that for the future, so that they will protect their costumer.

    Exactly there are so many companies that go to China to get there manufacturing costs way down!

    Was watching a programme where UK sellers who sold fake merchandise. One guy was selling for 3 years, made millions. When Trading Standards caught up with him, all he got was 1 year in jail! They never reclaimed all his profits, and he'll be out of jail in 6 months.

    I don't condone this, but no wonder eBay us exploding with this shenanigans!

    A lot of sellers seem to go out of their way to cover up logos from I've seen

    eBay doesn't notice all of that and most likely unless the buyer reports its fake eBay will never know. Many people can't tell the difference between a legitimate product and a fake

    1st of all, just because it says Made in China does not mean it is fake: for your info, Nike is Made in China, Emporio Armani is Made in China, Tissot is Made in China, New Balance Made in China... Apple is Made in China..... so just about everything is made in China. What you should be careful about is to make sure those brands are made under supervision from the brands, and not brand you find on Aliexpress or Dhgate...

    It is our duty to report the fake brands in eBay so that sellers selling fake products be banned.

    Like hatcruizer said many things in the united states and around the world are made in china nomatter if it's apple or nike because of cheap labor and many other benefits they gain. A phake item means it looks identical, but is not made of the same material of the original. If money did not exist and we all lived in paradise then you probably woudn't have to worry about phakes, but while money is needed to be made and to better yourselfes even if you don't like it then there will always be all kinds of markets. You might not agree with it, but that doesn't mean just because you buy an orginal that your doing a good thing. Your buying cheap labor where people die and have horrible lifes just to make the product you flash thinking your all cool. It's a messed up world. So if you want to do something about it make a company and make a product and pay your people fair prices help out the economy, it's a rough world.
