    Hi,

I really wonder if Facebook is doing anything about Facebook Fans sellers. You maybe heart of usocial dot ... that sold facebook friends and get stress with facebook and so they stop it. But the same company on the same website is still selling Facebook Fans - as many others else.

So anyone ever of you heart of anything were somebody got REAL problems with Facebook, I mean lawyer contact. If a accounts gets banned or a page deleted, its not so cool but it doesnt really matter that much. But if you got in problems with their lawyers, that could be big.

Anyone heart / read about this or have any personal experiences to share

Love it when people with no legal analysis comments.

    Read this link:
    http://www.allfacebook.com/cease-desist-usocial-2009-11

"USocial, a company which sells Facebook friends and fans, has received a cease and desist from Facebook for violating the company?s terms of service. "

    Thats one company lol.

Go to google and put in " Facebook fans " or " Buy facebook fans ".

If it was so much of a problem then they would've shut everyone of those sites down by now.

    That link also says:

"The real question though is whether or not Facebook allows the selling of fans and/or friends as long as user accounts aren?t being harvested or accessed through unauthorized means.

"While Facebook has explicitly stated that users cannot profit from their own profiles, it hasn?t been stated if third parties can sell friends or fans without providing monetary incentives to users. There is a rapidly increasing number of companies who sell fans to brands for Facebook Pages and it?s a topic which Facebook has yet to publicly comment on."

You can probably sell fans as long as you keep it under the radar. If you make a website and promote that you are selling fans they may try to threaten you. Will they actually file a lawsuit? I doubt it...not unless they thought you were big enough. Personally I would stick to selling fans as a service on sites like this.

That doesn't mean Facebook won't take you to court over it, where you will have to spend $40,000 in legal fees. Not to mention paying an attorney. Even if they're wrong and you're right - you'll have to spend money to prove it and you don't always get the money back.

The point I am making is that Facebook isn't hesitant to go to court because they got a $50 billion valuation - even if they're wrong. While they haven't mass shut down fan sellers yet, doesn't mean they won't tomorrow. People were flagrant about CPA offers on fan pages until the lawsuits came... people were also selling profiles... You want to be the first everyone talks when why you can't sell fans?

Ofcourse it's not legal, in fact it's kind of "selling people", which is illegal in every country in the world. But because people keep it under the radar, there's nothing to worry about. Plus the people that provide the service ussually invite people to the page, which isn't forbidden anywhere.

FB Fans is one of the items I sell, and have for quite a while. I keep it small and under the radar, and I haven't been bothered.

Does that mean I'll be able to do it forever?

    Probably not.

But until I get that C&D Letter....

if they cannot find you what can they do?

offshore hosting, buy domains in a safe place, Sweden is usually good, then their lawyers can spend years trying to find you but if they cannot then what can they really do?

Hi there. I read this and just had to reply, to clear things up and set things straight.

First. It is against FB's TOS to buy friends.
It is NOT against the TOS to buy Fans.

There is a big difference. First. A personal page is owned by FaceBook. A Fan page is not... so to speak. A fan page is hosted by FaceBook but not owned by FaceBook. Think about it. Coca-Cola has a FaceBook Fanpage. Does that mean FaceBook owns it? No.

With that said, the answer to everyones question is this. Buying Fans is not illegal and not against the FaceBook TOS.

A Fanpage is a business, brand or public person. But, a personal profile (As in someone who sends friend requests) is simply parking on FaceBooks property. Buying "Friends" is against the TOS because you are profiting off of FaceBook directly.

This is why buying Fans is not illegal. Picture it like this. If a comapny pays a bunch of people to plaster flyers on cars in a shopping center to promote their business, is that illegal? No. Or a big brand pays to run commercials on TV. Illegal? No. So long as it's Likes and not Friends getting purchased everything is fine. Hell. FaceBook itself sells fans now in the form of advertising. You pay to have your Fanpage show up on Facebook, but only pay if someone clicks on it and Likes your page.

Now, the shady part. You really need to watch who you buy fans from. Why? Because creating fake accounts is against the FB TOS. So, if you buy 1000 fans, and it turns out they are Fake accounts, one day you'll log on to find you're page missing all those fans. (And have no way to get your money back). Sooner or later it will happen. FB is not dumb and can connect the dots. Make sure you get "Real" people as fans. Harder to find, but providers are out there. Usually, the numbers aren't as high. EX: instead of selling 1000 fans, they may only be able to provide 100.

Another thing to note (And this is new) is the new EdgeRank (Pretty sure that's right) system FaceBook is now using. It decides if the Fans on your page are real (Using a bunch of factors including: Fan activity, friends, personal activity, and some secret formulas.) What does that mean? If you have a FB Page with 10000 Likes, but only 2 are active, you will NEVER show up in the FaceBook search results. That's a 2 second rundown of the new system. Look it up to find out more.

Anyhow. Hope that helped clear some things up. Take care all and feel free to ask any questions.

Plus, it's harder to find you if you are living in another country using b/s info. Yea they can send a cease and desist or try and get you to stop. If you keep moving around, changing hosts up, cover your tracks properly. It is unlikely they will find you, or it will take them a while before they do.

Do you think Ketanndu from Nigeria is going to care about FB?

They want you to get fans from Facebook Ads (their main revenue generator) not from buying or selling fans outside of their platform. They can and will still go after you. You may be under the radar and hell you maybe legally right but they can still take their claim against you in court. Court is expensive as hell. Even if you are right you will still have to pay court fees, lawyers fees and go into litigation into to prove it. The point is even if you are right in every way possible, they can still go after you to get what they want. There's a recent case about a guy who got a C&D and pretty much gave into their demands since he has a mortgage and a family, etc.
