Selling custom shoes on ebay? is it Illegal?

    I am a bit of a sneaker-head....


    And, A lot of my Air Jordan (not the classic retros) but a lot of them... I paint them different colors. I get compliments all day in the streets about how cool they are.

    I paint very good... I actually have all of the paint brushes, the correct dye, the correct tools and all to paint them.

    However, I just sold a pair on ebay... for $350.00 and I only paid $174.00 but the color way was just so dope, that the bidders were all in War to win these shoes. My roommate and I, literally thought that they were going to sell for about $200 but when we were watching the bidders fighting for these shoes. I was like.... HEY! I might have a new hustle here.

    I was thinking of painting and reselling... I just want to know is it illegal to do so.? Will I get sued for reselling customs?

    Sell more and see what happens lol

    But on side, there might be some trademark/copyright thing involved. But i dont think its illegal, its same like you are selling used shoes. You arent the one who makes brand new copies. So i would say its ok

    i agree, you are selling secondhand, so should be no issues.

    Who knows, if you make a good go of it, they may contact you for some kind of official deal :)

    No. It is not illegal. There is a new US Supreme Court case that addresses this issue via text books being sold. The US Supreme Court held that this did not violate copyright laws. So go for it.

    it is tottally not illegal at all. you are not changing the logo or anything. there is a store at my local mall that does custom jordans, its all the rage.

    I think you will be fine. You are not manufacturing replicas, you are modifying genuine products. It is like painting your car and sell it. Nobody can sue you because you painted a car before you sold it.

    As long as you have the invoice that you've purchased the original ones and they aren't the replicas, it should be all good.

    I have been selling on eBay for years. This sounds like a good idea, keep it up and start selling like crazy. I don't think its illegal.

    people sell custom jordans all the time if your selling on ebay i would at least have the receipt to prove there real and also make sure there labeled custom.

    While what you are doing is not illegal, many companies participate in ebays VERO program. It means they are the verified rights owner of the trademark and it allows them to have your auctions pulled and your ebay account suspended upon the second infraction. I don't know if Nike participates in VERO. Some companies are really anal about people reselling their products (although Nike seems to gain a lot through this secondary market for their goods). Some sellers get their auctions pulled right away, others operate for years before the company changes their policy and starts to crack down.

    You can fight these actions in court and easily win them. But it's a hassle not many people want to go through. Visit the tabberone website to read about some court battles with large companies.

    I would go ahead with your business idea. However, be prepared for the day that it might come to an abrupt end and you have to fight to stay in business.

    As long as they're obtained in a legitimate way and are indeed the real product you can redo and resell just about anything you want, there a tons of people who do it with shoes especially converse and the like.
