'Revenge porn' site owner arrested in San Diego

    'Revenge porn' site owner arrested in San Diego



    A 27-year-old man has been arrested in connection with the running of a "revenge porn" website.
    Kevin Bollaert is accused of being behind UGotPosted, a site that published intimate photographs of people against their wishes.
    It would link to relevant social networks of the subjects pictured.
    Prosecutors said the website also sought to extort money from the people featured on the site by charging a fee to have pictures taken down.
    "This website published intimate photos of unsuspecting victims and turned their public humiliation and betrayal into a commodity with the potential to devastate lives," San Francisco Attorney General Kamala Harris said in a statement.
    "Online predators that profit from the extortion of private photos will be investigated and prosecuted for this reprehensible and illegal internet activity."
    The authorities alleged that Mr Bollaert also ran changemyreputation.com, a site that offered services to have pictures from UGotPosted removed for a fee of about $300 (£180).
    According to court documents, he is said to have made "around $900 per month from advertising on the site and records obtained from his changemyreputation.com PayPal account indicate that he received payments totalling tens of thousands of dollars".
    More than 10,000 images had been posted to the site, arranged by location, police said.
    In addition to the photographs, each entry would display a range of contact details - including links to Facebook, Twitter, LinkedIn, places of work and other personal information.
    Mr Bollaert is being held in a San Diego jail on $50,000 (£30,000) bail. He has not yet entered a plea.
    Distress
    As part of the investigation, a search warrant was obtained to look through emails sent to ugotposted@gmail.com - the address used by the site administrator.

    "Please help!" read one email. "I am scared for my life!"
    The woman - named in court only as Jane Doe #6 - said she felt unable to go back to work as people who had seen the picture had then called her office.
    Jane Doe #6 also noted that she may have been under 18 years old when the pictures in question had been taken.
    Another victim said over 100 people had tried to contact her after being featured on the website.
    ID theft
    Revenge porn sites have typically been difficult to shut down thanks to what many see as outdated laws surrounding the publishing of images.
    A common hurdle for law enforcement is the Communications Decency Act, which has been used as a defence for website owners who have found their services being used for hosting or distributing illegal material.
    The crime - the defendants have repeatedly successfully argued - is perpetrated by the user who uploaded the images, not the owner of the website.
    Another closed revenge porn site, IsAnyoneUp.com, was targeted by campaigners who said it was a gross invasion of privacy.
    However, in this case the most effective way to see the content removed, at least from Google search results, was by using copyright law.
    If the person in a picture also took it - a "selfie" - then a copyright claim can be made to search engines under the Digital Millennium Copyright Act, known as DMCA, designed to make it easier to stop pirated content from spreading online.
    In targeting UGotPosted, prosecutors used a different approach - pressing charges of ID theft and extortion.
    Law makers in several US states are looking at ways to crack down on revenge porn.
    In October, California enacted a new law that made posting explicit images of someone without permission punishable with six months in prison.

    An interesting story. It will be racketeering they get him for no doubt...It seems to be the textbook definition. As it is said, the crime is committed by the uploader, not the host. If there is a crime at all.

    The thing about pictures is that the person who takes it is the owner, not the person depicted, so a guy who takes a picture of his girlfriend is entitled to do anything he likes with it, even upload it to the internet if he so chooses. I'm not sure what privacy laws are like in the US to protect people, but in the UK there are none. This scheme would be perfectly legal, apart from the whole racket he was operating.

    Hunter was making $10k+/month,the other guy was just a copycat,he obviously didnt have the traffic YET.
    Also,it is perfectly legal what they are doing if they are just hosting and not uploading.For example see any tube.

    On the other hand, FUCK HIM... Fuck him. There are Millions of ways to make money online without being an asshole and destroying lives.

    And don't get me wrong, i'm not one of the morally correct and politically correct assholes/people. I don't care you selling drugs, guns, do whatever you wanna do it's none of my business, but this is messed up.

    And i'd wish evil for no man, but maybe his cellmate can take some pictures and i can throw up a site and see how he likes it. I'll also do the whole 9 yards, fan page, google+ page, twitter account, pinterest, backlins, traffic exchange, i'll make him famous, and charge $25.000 to take the pictures down. Cool? :D

    Oh and the whole "we are just hosting the pictures, not uploading them" argument is a total cop-out.. Just an excuse to avoid responsibility. Now, i'd use this excuse too, but i wouldn't fuck people over like that just to make a little money...

    I don't really agree with the method he was using to make money. In terms of the law it is not a good thing to do, let alone morals.
    How would he feel if pictures of him or someone he cared about were posted online!

    In the US, anytime you publish a picture online of anyone who is recognizable, you need a models release, and it better contain language that allows for use in an embarrassing manner to really cover you.

    Look at any photographers models release, and you will see what I mean.

    So, if the law wants to stop this kid of stuff, the law has to change.

    Right now, only the individual victimized can do anything about it, and they must initiate a civil lawsuit to do so.

    This guy is going down for blackmail most probably though, from the way it was set up.

    It just boils down to some people being scumbags, and finding a scumbag way to make money.

    It does not matter if you agree with what they did for a quick buck or if you disagree and think it is ethically wrong.
    One thing I think we can all agree on is they were dumb as shit to plaster their personal information and pictures
    in connection to this.

    I'm confused. So this guy just found pictures that were online and re-posted them? There are thousands of tumblr accounts doing this right now. Not to mention the mug shot sites are using the exact same business model as these guys and there havn't been any arrests relating to those as far as i know.
