Received an email about Subpoena from cloudflare(I Run adult site)

    Hello guys, so i received an email on my hotmail from cloudflare, its from this email : [email protected], the content is like this :

    To Whom It May Concern:


    We received the attached subpoena regarding a domain(xxxxxxx.{com) managed through your Cloudflare account.


    The subpoena requires us to provide information in our systems related to these websites. We have determined that this is a valid subpoena, and we are required to provide the requested information. In accordance with our Privacy Policy, we are informing you before we provide any of the requested subscriber information.


    We plan to turn over documents in response to the subpoena unless you intervene in the case within one (1) week of the date of this notice. Please know that removing or deleting content will not halt this process. If you plan to intervene in this process, we would suggest that you contact local counsel at your earliest convenience.

    So my concern is is this a fake email ? or anyone received this email before ? I can't remember if i used my own house IP to make this cloudflare account, but when i login, there's no information that i put like my house address. I think i deleted my site before on my cloudflare account. Any advice ? :eek: I have a feeling if cloudflare gave them my ip which i used before i might be busted:weep:

    On their transparency page you can find this part:

    It is our policy to notify our customers of a subpoena or other legal process requesting their customer or billing information before disclosure of information, whether that legal process comes from the government or private parties involved in civil litigation, unless legally prohibited.

    Btw thanks for the info, i also using cloudflare.

    That depends if you're from California. Id contact a lawyer if I was you. Do you phisicaly store the stołen content? If not then all they gonna do is scare the shit out of you. They want to search your property and it doesnt say much more. Why would you use real name with cloudflare anyway.

    That is not fake. It looks like you are being sued for copyright infringement.

    In order to sue, the suing party needs your information so they can serve you. They have subpoenaed Cloudflare for your information. Cloudflare is legally required to provide all the information requested or they will be in contempt of a court order. Cloudflare would need to go to court to oppose the subpoena if they wanted to fight it, but they won't do this as most corporations would not.

    Once Cloudflare turns over your personal information as well as any other information requested, which could include server logs and other records regarding the contested material, you will hear directly from the applicant.

    If you are in an untouchable country or legally protected from the action from this jurisdiction then you may be able to tell them to pound sand.

    If you are within their jurisdiction you will need to deal with this.

    From the document you provided it looks like a purely civil action (DMCA subpoena). So you are in no danger of a criminal conviction or going to jail. They are suing for money.

    It would be best to consult a lawyer once you get the details from them. Most likely they will settle out of court if you can come to a financial arrangement agreeable to both you and them. If you do not settle, they will be forced to take you to court in order to get a judgement.

    The question is, if you refuse to settle will they think it is worth the trouble of going to court against you?

    If they do go to court and get a judgement and you refuse to pay, they will have to seek enforcement of the court order.

    If you are in a safe country, you may be able to ignore any judgement and just avoid doing any business within or visiting the jurisdiction.

    Have you protected yourself financially by creating a Limited Liability Company or other such business entity? If you have, their damages may be limited to the assets of the business entity that owns the site. If you have not protected your self and are, for example, working as a sole proprietor, you would most likely be personally liable for any damages.

    The fact that they have gone so far as to subpoena records shows they are serious. The contact information for the law firm is on the subpoena so you could contact them to find out what's going on, or you could keep a low profile and wait for them to find you.

    To reassure you, this is not the cops or the feds pursuing a criminal action. This is the copyright holder suing for $$$.

    Remove the site and run, as much as you give them attention they will be more annoying. Move the host somewhere else and u are done.

    The subpoena isn't to you. It is to Cloudflare. I would not advise responding. Cloudflare is only required to provide the information that it has on file. It is reaching out so that it can provide more information and look good to the other party so it doesn't get dragged into the suit. If you want to start a fight get a lawyer and respond. But if you don't, don't respond and lay low.

    I also own an adult site and haven't heard of this actually happening until now. Do you know which company is actually sueing? What kind of videos/niche were you hosting?

    my guess its fake. You can always call them and ask about it. But usually if you get a subpoena its going to be hand delivered to you.

    The subpoena was served to the hosting company. The hosting company then contacted him. Don't see what sounds fake about that.

    Its real. And as stated above, it's about content that isn't yours. Usually if you take it down immediately, by the time they get their information, you'll be good. There are some jackasses out there who will continue to pursue to get any money they can out of you. I'd ignore cloudflare, delete the content you took. If its all stolen, you got work to do.

    fuk them. dont reply, dont give any of your logs, also keep that mail saved. hopefully when years later someone will be suing cloudflare for Sharing their private info without consent you can also claim a chunk of money from them.

    that's what i will be doing, just did a quick check and it cost cheap to get subpoena. what i will do is to wait and see how they will do to me. no risk no gain :D

    So much stupidity in this thread... One clown saying the email is fake, another saying cloudflare should be sued... But that's what you get when you seek legal advice on a forum instead of talking to a lawyer
