question about emaling

    Hey guys ,
    so someone has been doing emailing with a vps using one of my domainnames , and today i received a complain from a person who wants his email deleted from our emailing list , he used whoisguard to email me since i'm using it for the domainname . My question is can people sue me for this unwanted emails ? I'm not the one who send those emails but a friend of mine , he is giving the unsubscribe link in each mail and all the cpa accounts he's using are under his name not mine . so can i have any legal problems from allowing him to send from my domain names , witch have my real information on my domain registrar ?

    Are you spamming or was your email list opt-in?

    Technically if you're in the US you could find yourself in trouble, but I would say that he's more likely to get in trouble than you, especially since everything is in his name.

    i'm in france , and he is in morocco , i bought him the domain names since he couldn't use paypal in morocco , he is spamming , those are not opt-ins , i asked him to change domain names by the start of the next month , do you think i can get any trouble from that complain ? Since i don't want any troubles especially from something i don't use myself lol

    I think if you follow this word by word, you are on the safe side.
    I am spamming from time to time, in total ~5,000,000 or so, and i had no problems so far.

    Edit:
    Why is your "friend" using your domains ? If he can't use PP in Marocco, he can use his Debit/Credit card ...
    I think he will spam using your name and if anything goes wrong, you are the one who is going to bite the dust.

    Make sure if you are in the U.S that you are following the can spam act. If you are not following the can spam act and you get caught I believe, but don't quote me on this, it is a $10,000 fine.

    he's actually my friend irl , and most of credit cards in morocco can't be used for online payments, anyway , he will be changing all his domain names by the start of april , also he is giving the adress and the unsubscribe link so i think he is good according to the can spam act
