    How can people with selling unofficial Harry Potter books and merchandise on Etsy etc. without getting Cease and Desist and sued etc from that Rowling bird?

    Most likely one of two things.

    First, she's not really obligated to send out C&D letters to anyone doing anything remotely related to HP. Those sellers could simply be under her radar or she doesn't really think it's interfering with her current business interests anyway.

    Second, depending on what the specific thing is, it could simply fall under "fair use", where they're not really trying to imitate an existing licensed product and there is substantial original work involved. For example, you can't be sued for writing a Harry Potter fan fiction. (Though, to be fair, I'm not as clear on the rules if you're trying to sell it.)

    Nah you got it a bit wrong.

    These people on Amazon are selling the books etc. and on Etsy

    I was told by Apple to remove some cards in a game as inapp purchases that if I did not have permission to be advised to remove them which I did, but other people are blatantly selling stuff.

    This is not my book right but you search Amazon for potter cookbook and see as I wrote to the woman asking for licensing my cards cause I am honest bloke and she has not replied to me.

    There you go, those people just gamble.

    I wouldn't have replied to you either. HP licensing is done by Warner Bros. Consumer Products, Inc.

    The woman is the author and she approves everything.

    Anyway single people trying to get somewhere are ignored with licensing as I also wrote to Dr Who, Pokemon, Star Wars and all did not even reply or some said sorry not for us.

    I actually think I come under fair use as it is own art doodles.

    There are hundreds if not thousands of HP products around the world licensed, do you really think she spends all day long looking at applications? And not let WB handle it?
