paypal threaten legal action- UK- How to tell them to go away legally

    I got this info from another site, could be useful details

    In the Uk Paypal sell all the debts onto a debt collection company, I am not sure what they do around the world but they may do the same

    so the following may cover you in your country too;

    So for some reason you have a negative balance with paypal?

    And i bet its really uncalled for ... i bet they probably just decided to refund somebody without asking you, leaving you with a negative balance right?

    Next step is you have recieved that call from Iqor Recovery Service!! Worried? Don't Be!

    Let's have a look at my experience first..

    I decided to sell a few things on eBay, sold them .. put the money in my bank .. done and dusted.. untill i recieved an email asking me to resolve a negative balance!! paypal had decided to just refund somebody without telling me, well, they've made their bed ... they can sleep in it.

    Few weeks later i recieve the contact from iqor recovery service and in a few minuites work its all blown over! thats if you "owe" paypal £10 or £100,000!!! so what did i do?

    1. As soon as you get the phone call don't give them any info, don't "confirm your adress" don't "confirm you date of birth"... they called you .. they know who they are speaking to, you have no legal obligation to provide this information. They cannot speak to you now so will hang up. Rule number 1: they can only make contact once a week. This doesnt include answerphone messages, emails or letter but as of actually making contact they can only do this once a week, they will ring you back the next day ... once you let them know you know the law they will back off and stop calling!

    2. Its not over yet though, now your letter will come! with a free post envolope, now my first thoughts were to fill it to the brim with junk mail or stones or whatever or even just send them an empty envolope back with IMPORTANT written on it, but lets take it a little more serious.

    3. Now before you do anything on your reply lets start with writing in massive bold letters "I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY" dont do that and you are basically saying you know you owe them money.

    Now we would like them to provide a copy of the Signed, Excuted Credit Agreement via a Consumer Credit Act (CCA) request. to prove you owe them money, you can find a template for this letter here http://www.consumeractiongroup.co.uk/forum/general-debt/20758-creditors-dcas-letter-templates.html i would then send this via recorded delivery, just to make sure they don't claim to have not got the letter. You'd think they would get this info to you sharpish right? well untill this matter is settled you don't owe them anything, and if they fail to provide this within a month, THEY are breaking the law. Under the data protection act, if they dont supply you with this info, they are to cease processing any of your data immediately!

    4. There is a highly likely chance that they don't actually have the document as paypal don't have any signed documentation to say you owe them any money, there is no written contract between you and paypal, and a simple click here to accept terms and conditions won't stand up in court.

    5. They know you know your stuff, they know you know you dont have to pay this money, they know their agression won't work, keep calling or writing to you ... its time to tell trading standards! this is all it takes, no court cases, no worried to answer your phone .. relax ... do these points ... and get on with life [​IMG]

    Some Points To Consider
    • When Iqor Phones you they will be very rude and agressive and make all sorts of threats, i know some people who iqor have been "filing a court case" for 6 months now, don't give in and pay! they use they're agression to try and get the money out of you
    • When they call dont confirm who you are!!!! if they then continue to talk to you about your "debt" reply with "i don't have a debt with paypal" to any question they ask, and say it calmly, once they have hung up, job done!
    • They are not allowed to make contact during work hours, or after 7pm if they do, tell them this and hang up.
    If anybody has any letters, i would be happy to write them a reply!, pm me and i will sort it out, purely for hate of this company!

    Hope this has been helpfull, and hope this at least stops a few more people haveing money taken off them that they don't owe!

    See, the problem with fucking around with debt collection agencies is that they can and most likely will fuck with your credit record. So later on in life if you need a loan to buy something big, whether it be a house, a car, or even just a personal loan, the financial institutions will look back at your credit record and it will show that you owed $X amount of money at X/X/XXXX.

    Good idea but it does not need to be so fancy, any cease and decist letter will work fine all you have to do is mail it to them registered. Doesn't matter if you write in big lettering or not once you send them a legal document they are obliged to follow the law.

    This is freeman stuff basically you use common law and turn it against them.

    The thing is your original dealing was with gaypal and they should notify you they are selling your info on to the DCA. So when they pass the debt on to the agency technically your debt has been paid!

    wished i had known this info like 3-4 years ago would have saved a small fortune, currently with stealth accounts ebay fees , i pay them till account get suspended normally my accounts last 2-3 months and over 100 feeedback then all of sudden they send and email saying due to this and that we decided to close the account , great now i dont have to pay that fees :)

    In the UK there is now no requirement for them to provide the original credit agreement, just enough evidence to show there was an agreement to start with.

    Sorry but I have never seen a thread with so much mis-information!

    There is no 'credit agreement' Paypal is a bank! Its regulator is based in Luxembourg.

    It's simple really - in this situation ignore everything - every letter and phone call.

    If they are calling you all the time then send the following

    If they continue with the calls then contact OFCOM.

    They will not take court action against you so ignore the letters and relax.

    OH and by the way there is NO CREDIT AGREEMENT and only a County Court Judgement will show on your credit file so double relax!

    Agree with the last post. In Canada anyway, if you tell them not to call you at that number again VERBALLY they are required under the terms of their Lic to comply (found this out over a stupid parking ticket). Additionally they may threaten to report you to the credit bureau, which they may, however the credit b has thresholds and anything under $150.00 (not sure about that figure exactly) will not be posted. This is a per incident basis as well so if there are 4 parking tickets for $50.00 each, my understanding is that they can't report $200.00 it must be $50.00 x 4 and this does not meet the threshold.

    So I sold an antique item worth over £500 for a mere £226.78. The buyer payed using paypal and so I sent it off recorded delivery.

    About 2 months after the item arrived (I had checked confirmation) I tried to pay for an item using paypal only to be told my account was limitied. I logged in and found that I had 6 (yes 6!) cases open from the same buyer for the same case. They all aid different things! One said not arrived, one said damaged, one said parts missing etc.

    I contacted paypal with the delivery confirmation and that case I won, however I 'lost' the other 5 and therefore the buyer was refunded. I had lost my item and my money!

    I recieved emails from paypal claiming if I did not resolve my balance I would be handed over to debt collectors. Anyway I basically told them to p*ss off. I gave them the evidence and told them how unfair it was that she had a case open against me for practically every possible reason.

    Anyway, THE letter from iqor arrived last week on the 5th April.

    Basically saying, I owe them £226.78 and if I don't pay I MAY be taken to the sheriff court, (do we even have a sheriff court in England?), debt collectors MAY come around and my credit rating WILL be damaged.

    Well luckily my A* in Law at A-Level tells me that the only way my credit will be damaged is if I am taken to court and forced to pay the fee (well if this does happen(which it more than likely wont) I will pay the fee as its not worth the agro of credit history.

    Well I searched the internet found this amazing blog and sent the letter to them recorded delivery. They received the letter this morning to I am just waiting for a response from them.

    Luckily I put an old phone number in paypal when I signed up (I signed up in around 2009 and I changed my phone number in 2011 and just forgot to change it) so I have had to calls.

    Is there anything else I can do?

    This company really annoys me! I did nothing wrong and yet I am being made to pay for a crooks crime!

    How long is the time frame between them receiving the letter and deleting my details?

    They got you adress? I also owe them 180 bucks. And I got my real bank account and adress.
