PAYPAL ACCOUNT LIMITED ! AND I GOT THIS MESSAGE !

OP, good news is since you're not from US, they won't bother since you've refrained from selling their product. No one's got money to spend to bar someone that already left their sh*t for them especially since you're not the only one in this.

They only want to stop you guys from selling their product.

Bad news is your money is gone .. that's for sure. No such thing as 180 days hold in this case. Like finally gone.

As most have said, usually they are not going to bother about you since you are not in US. But your money is completely fucked up. However, if you live in a first world country talk with a lawyer

i hope so , thank you for your reply

How much money are we talking about? You said you only sold 2-3 items? The "judgement" if there's one will not be much, and you are mostly looking at a financial liability. A lot of people on here trying to scare you. Nonetheless you should still seek true legal advice and do more research on your own, but you have to factor in how much of their time and resources is worth coming after you? Unless you're some major seller and you have deliberately avoided a cease and desist, you don't have a lot to worry about. Lastly, just because other people are selling it does not make it right. Imagine if you were a street dealer, would you think you could use the same excuse to the police when arrested? "oh sorry officer, but there are like 20 other guys around the corner doing the same thing!". I once got a cease and desist letter from a cell phone case company because the product being sold to me from China was a ripoff of a real brand in California. I didn't know and had to shut down the store immediately and ended up with over 300 cell phone cases sitting in my office.

You sold 3 items and they ask you 6 000$? What was the cost of each item, are they really able to ask you so much?

I have received this message saying that im named as a Defandant in a lawsuit , actually im not a US citizen , what are the consequences ? and does any one had a similar situation ?

this is the message :

You have been named as a Defendant in a lawsuit brought by General Tools and Instruments for trademark infringement, counterfeiting, sales of counterfeit goods, and other torts as described in the Complaint as attached and served upon you per the Court's ....

Actually i have been selling this item three or two months ago , drop shipped from Amazon , and i made 3 or 4 sales , that's it ! .. and everyone is selling it all over the EBAY and AMAZON markets . They have sued alot of people's store . Is this will escalate to me as a citizen , or just a virtual judgement like SHUTTING MY PAYPAL ACCOUNT OFF AND TAKING MONEY ? any idea guys ?
Please HELP !

I received a message like her. Can I know if the case ended with you

Don't worry. You're not a US citizen and that company is not going to waste a lot of time/effort/resources to sue you in your home country. The court order will just to stop and seize your Paypal account.

Does this not fall under first sale doctrine? I’m not a lawyer so I’m curious. If you legally purchased it from amazon then resold can they really sue you?

I would just pretend you never saw any message from them. Law offices make a lot of money by saying "give us $6k and this goes away" people will usually just pay the $6k.

If they want to bring this in front of a court they will need have lawyers in your country to handle it on their behalf which costs a lot more money and it needs to be worth it for them. Which it doesn't seem like it is.

If they are summoning you to a court, they need to prove you've received the court order in person or virtually, which is hard to prove.

What it seems like to me is this company hired a law office to mass spam out these scary letters to paypal accounts associated with selling these products in the hope they'll get a bunch of sellers that will pay the $6k.

I'm not a lawyer, so don't take what I say as gospel. I have just seen this shit happen a lot :)

It will cost them more to sue you.. I think they just want to make sure you won't do that again lol
