Paid for registration of a domain but they are not registering it for me.

    Hello, I am in a situation. I have paid for my domain registration but the domain register did not register the domain for me. Its been 10 days but they are saying they are having some kind of bug in their system. I don't want to mention that register's name yet as they told me they will solve the problem but as the domain is still free to register (I checked with whois), anyone can register that domain while they fix the bug. What I want to know is if that domain got registered by someone else from any other register, what are the legal steps I can take? As the domain registration always automated now but they didn't handed over the domain yet after so many days is it possible to sue them? Please give me a solution. Thanks in advance.

    Easy solution, go with other domain registrat and buy your domain, and ask to cancel your order and refound you from registrat one.

    p.s. I am surprised you are not lazy to sue someone and opening thread, but lazy to think for a moment to find solution

    It would help you you did say who the registrar is as we could let you know our own experiences.

    I have never purchased a domain that didn't go through immediately, so it sounds fishy to me.

    Namecheap had a problem like that a few weeks back... hit up support and ask them to manually register it for you.

    m.rvs2141 To be honest I am bit angry with them!! Why? Because I sent them emails, contacted via their facebook support page but they didn't respond to my emails and messages for long time and when they did, their solution was not helpful at all. I am not lazy do to anything that relates to my business whether it is opening a thread for help or it is sue them to send them a message that their business is running because peoples like us pays for their services. I could register the domain somewhere else after it failed here but they were telling me lies that, it can't be registered from somewhere else because I already submitted the domain to them to register!! ( I am using namecheap and name for years and never had issue with them) I checked with both namecheap & name both of them showed that I can register that domain but I didn't do it. That is why I am asking the question here.


    BassTrackerBoats I am using namecheap for long time, whenever I had any issue with them, they solved it quickly from live chat or email.

    OP,

    Unless you say who the registrar is nobody can really give any opinion on whether they are reputable or not.

    If I were you though, I would register the domain elsewhere to make sure you own it.

    At any point someone else could take it so if the domain is important to you, don't risk that happening.

    10 days is an absurd time. I wouldn't have waited more than 15 minutes to go with the next registrar. How can you afford to waste 10 days like that?

    That is a reputable company for sure. I will post their name after solving the issue I am having with them, I am sure you will understand why I am not posting their name yet but I know it is important for your guys to know the name. But when it comes to taking legal actions against a domain registrar who has agreed to follow the rules of ICANN. Can't we do anything in this situation? Is my role with the domain registrar just a tiny webmaster with no rights or law in my support? This is crazy.

    ask for a refund, register the domain with namecheap/moniker and let everyone know about this domain registrar. Simple.

    Just go for a different regirtrar, you might lose your domain if you keep waiting.

    SkyrocketSEO I am not crying buddy... I am just angry.. Thanks for your godaddy suggestion, I don't want to make another by going with shady company like godaddy. Happy with namecheap, name, dynadot and moniker. Too bad still didn't find any serious help to take legal action against their illegal act.

    Depending on your location, you will probably have Consumer Laws to protect you.
    You have been given advice in the thread, I don't understand why you don't follow it.
    When you said you paid for the domain, has the amount been debited from your credit card?
    Just register the domain elsewhere and request a refund.
    Why do you want to sue/take legal action? Is there more to this thread than you are letting on?

    If you want to take legal action you need to speak to a lawyer, not us.

    Plus I think you'll find they have almost certainly not broken the law.

    And any delay in processing your purchase will be covered by their T&Cs

    Thought get some suggestions from others experience, that is the reason behind starting this thread. I was not seeking for a lawyer here on this board. I thought I would get some suggestions about violating their SLA but looks like none is familiar with such issue. I thought we do go through an agreement when we buy a domain and pay for it. So if someone register that domain from namecheap, will my current domain registrar stays in safe side? Won't it be breaking the SLA or anything like that because I am the one with the invoice/receipt for that domain?

    It looks like you are looking for an excuse to take legal action.

    (IMO) If the domain is still available to register then whoever does register it first will be the owner.
    The fact your registrar has charged you for the domain but not registered it, may be breach of contract but it would not give you rights to the domain (IMO). These are legal issues that can only be answered by a legal expert (Solicitor/Lawyer).

    Just pick it up somewhere else and move on with things.

    Exactly.

    If you think you can sue them for millions lol, you are mistaken. Unless you can show you have suffered a substantial loss, then I doubt you would have a case. The courts take a very dim view of BS cases with no grounds.
