I run an offline business. Last year I was ranking top 3 then got a penalty to -100. So I decided to start a new site. So I got my new site to top 3 and after the last update my old site came back. So now for my local search terms one business is #2 and the other is #3. One is in places and the other is not. They both have 2 different business names but under same hosting and my name is on both of them.

Now I am worried this is against G TOS and both of them get penalty. What should I do?!

If Google have just removed the penalty from your old site, what makes you think they would now penalise both sites? Surely they are well aware that both the sites are on the same hosting and that your name is on both of them - it was their choice to return the old site to its former glory so I'd wager that they didn't see an issue with ranking two sites.

So in answer to your question, you should do nothing. Just be grateful that Google has done this and that you now own even more valuable search engine real estate.
