    From a russian, or other foreign IP. Does not mean whoever presses the button is "in russia".

    It's a Canadian law, and there's a 3 year transition period ? Senders have a 3 year grace period to gain consent of individuals, though your statement is still valid. :)

    If I understand that correctly, that means that if you email me without my permission I can then sue you personally? That would bring about the biggest clusterfuck in their civil courts ever. What's worse is it looks like the burden of proof would be on the sender. So if I didn't like you, or I was broke, I could just say that you spammed me and it's on you to prove that I've given you my explicit permission to contact me. Doesn't sound very well thought-out. I have to be missing something, I can't see how that would ever work realistically.

    I posted about this recently a case has already been won iirc, it was John Lewis a major department store who were banged to rights for spamming due to implied consent, rather than explicit click the box opt in.

    No body responded to that thread so I just sat in the corner and harumphed a bit.

    I'm from Canada, and trust me, most email marketers aren't even aware of this piece of legislation, never mind consumers, so I wouldn't worry about it. Besides, it would be really hard for a civilian to take you to court, and with Canadian law, the plaintiff would to prove that they did not provide consent, which would be pretty difficult...

    Also, I doubt they would even proceed with a claim against a foreigner (non-Canadian), so if you're business isn't located in Canada, there's nothing to worry about IMO.
