[NeedHelp] What does the law say about proxies? Are there any law-students that can help?

    I've been using proxies since (what feels like) the beginning of time, but never knew what the laws on this are.
    Questions:

    1) Are you allowed (by US law) to use public proxies?

    It's not really "breaking into someone's computer" if the proxies don't have any authentication right?

    2) Are you allowed to sell (port-scanned or not) public proxies?
    Aren't you technically just giving away information, the same way Google is indexing websites?

    I could really use some advice on this- thanks

    It's not illegal to use proxies. I mean if it is, the members of this entire forum would be jailed.

    you can freely use public proxies, thats why they are public proxies

    now if you do a portscan for proxies, thats completely different story..

    I don't know what you are expecting, or looking to hear here. If you're using someone's computer, be it a misconfigured server, open port, or an infection, it doesn't really matter. If you're on a site that is providing you open access to it's own servers to use as web proxies that's a different story, but they're also giving you permission. Otherwise though it's certainly not condoned anywhere, and although I'm not sure of the exact law, I am fairly sure there is one against using someone's computer without their knowledge. That being said, I can't think of a single person I've ever known that's got in trouble for using open proxies like that. I'm not saying you can't, because there's honey pots setup on purpose just to catch people. If you're not doing anything super illegal though chances are you'll never hear a word about it. At any given time there's a quite a few people that are probably using that same proxy, and unless you were doing something that really stuck out in such an incredible way, they're not going to single you out. It's like a lot of other things out there, take as many precautions and measures as you can to protect yourself, and use cautiously. If you want a more "legal" answer you'll probably be better of using Google.

    Well that would really suck if they were. A lot of people use them cause there countries are strict controlling assholes and won't allow facebook in the country
