Need you help people

    I got a message about a link on my site saying:

    DMCA Violation - Take down notice

    In th end it was written:

    "I have a good faith belief that use of the aforementioned material is
    not authorized by the copyright owner, its agents, or the law.

    The information in the notice is accurate, under penalty of perjury."


    I deleted the file immediately but i want to know what that message mean?
    I got freaked out by that message and i dont want trubles.
    Please tell me if its something serious or not.

    It isn't serious. It was a message by someone who "believes" the material you had posted...was not your material. Never worry about these things. If it is not your material..simply take it down. If it is your material...tell them to go fuck themselves. Nothing more will come of this.

    Don't worry about it, as long as you take it down you're OK. Whatever you do, don't admit to any kind of guilt and don't admit that you personally uploaded it. If pressed, say that it's user generated content that you didn't have any control over, and you deleted it when it was brought to your attention.

    If you say it was user uploaded content and that you didn't / don't monitor user uploads, you are protected under the safe harbour provision of the DMCA. It's basically what Google and the illegal porn tube sites hide behind to get away with hosting other people's copyrighted content.

    Wasn't there a post on here somewhere with a guy asking about using FAKE DCMA notices to take down the competition?

    Maybe he sent you this to scare you off OP.

    Or maybe other people who had the same idea did the same.

    Just a hunch.....

    Could be a fake....

    If it were me...I would wait for a real cease and desist...but I'm not real scared of lawsuits.

    I deleted the post and sent him a message about it.
    The download link of my post to his product was a medifire link and not hosted on my
    server, does it matter?
    Also, how can i take my site down until i get some offshore hosting and whoisguard?

    You are waaaay too freaked out over this.

    Go on with your business and just forget about it. Nothing will happen to you. 99.9% of the time....if you just take down and offending material...you will be fine. Don't take your site down. Don't switch servers....it is unnecessary.

    Cuase i am new to this kind of things and i dont know what to do about it.
    I already deleted the content and sent a message about it to the "owner".
    Now what should i do cause i cant relax because of this?

    Don't do anything. 99.9% chance you're in the clear now. In future, don't reply to them - just take the stuff down and move on. Bear in mind that anything you write to them could potentially used in court.

    Oh yeah, was the content your own original stuff or was it scraped? If it's genuinely original, you can tell them to get fucked. If it is scraped, take it down just to avoid any trouble. No point in taking risks.

    It was scraped but not hosted on my site or server.
    I deleted the post and sent him a message saying that the links was not my links
    but i still deleted the post and wished him all the best.
    You think this will help me?

    You don't need help...this is not a serious issue. Next time this happens...ignore him. But yes you will be fine...kindness never hurts if you do insist on freaking out and speaking to him :D

    hey... i receive some emails from "lawyers" now and then wanting me to remove some stuff on my sites... the first time I was using unprotected domain.. so I received a real mail from a lawyer, I was scared and replied.. I used a lawyer to help me and lost a lot of money using my lawyer.. I dont recommend to speak to a lawyer because he can ruin you as well.

    What I do now?
    1. all my domains are whois protected.
    2. for some projects I am using offshore hosting
    3. I ignore all complaints
    4. I try to be anonymous all the time
    5. disable google/yahoo/bing cache
    6. block all "strange" bots, especially archive.org

    Just ignore the email and do something if you receive a real letter.. but try to be silent and dont argue with them. (at least calm down first and take action in few days)

    Whats are the steps for that and can it be done for free?
    And how to transfer the domain as well?

    If you're getting properly formatted DMCA requests then you need to be honouring them. If you don't take stuff down in a reasonable amount of time, your host is well within their rights to suspend you (and probably will to save their own asses) and you can no longer hide behind the safe harbour clause.
