I have just recently launched a new website.

It's a sales page website with a squeeze page and afterward sales page (pretty olde school), and I checked my stats, and the top referral traffic source was from this one website...

When I went to check the site out, I'm shocked that it is the EXACT same website on a completely different domain name posing as mine!

LITERALLY! The same font, font size, color, background, everything!

The exact same website on a different domain name.

I don't know how they go access to the code (probably from view source), but it's the same site of mine.

But another dilemma is, that is where majority of traffic is coming from but downside it's duplicated content.

    Tough predicament I'm in...

    What should I do?

If I were to report it, who/where should I go?

Report it to their hosting provider, explain to them what happened. They will take down the site in no time.

Are you making any sales with the traffic he is sending you? if not most likely the traffic you see is from him looking at your website. I would weigh the bad and the good. If he was an affiliate under you, you could earn money each time someone buys the product. What I would do is set up an affiliate program with your offer and then e-mail the site owner saying something a long the lines of a DCMA but give him the benefit of the doubt. Which would be to sign him up to receive commission from the sales. Instead of stealing :)

Of course I wouldn't mind him being an affiliate, but the problem is copying my entire website exactly, the copy, coloring, background, everything; it's a clone of my site.

The thing is I'm concerned about duplicated content penalty because of this.

And I looked up the whois and it's some person in China and the host is in China.

That's the problem I'm not sure about with DCMA.

I don't agree with this at all. It really depends which hosting provider he is with, and how they handle such complaints. I have never seen a host take down duplicate content unless it was something that is clearly copyrighted. If I were in this place, I would just ignore it. Duplicate content isn't that big of a deal, don't be so concerned.

    What's even weird...

is that I just updated my site completely, and I immediately check this exact cloned site of mine on its domain, and I'm shocked by how it's all of a sudden updated as well!

At first I thought, they were simply copying and pasting the code from "View Source" but now I think it's somehow connected to my site and his.

    What is going on?

It's easy. Serve them with a DMCA notice. Write an email to the owner of the site and if he doesn't respond write to his hosting provider. Usually Host take DMCA very seriously. If your website content (text, images etc) is original and you own it then you are automatically covered by DMCA. I have taken down so many websites which copied content from our company site. Usually a email to hosting is enough.

Are you sure it's not a social bookmarked site similar to stumbleupon? A lot of them copy your site but all the links go to the real site (at least external links like Amazon and I assume ad clicks). I think anyway.

As xxsaumitraxx mentioned above, it sounds like he is using an iframe, so it actually is your site, with the same links etc. so if you don't have an affiliate program I don't understand why he would send you traffic.

Are all of your images watermarked and pointing to your site? I had a Chinese site re-purpose all of my images.

There is a script that does that. I had one like this. Click on the order page on his site and see if it redirects to your site or not. If it does, then the person is your affiliate. I don't think there is anything to worry about. Duplicate content is all over. Since you are the original owner, not to worry.

Why would you get a duplicate content penalty? He scraped you. If it was that easy to penalize someone, everyone would just go copy their comp's site, and presto, #1 in the serps.

These things will happen all the time.
The simple way to solve this problem is that you can send a mail to the hosting company and to the owner of the site and tell them to do something with this.
Probably the hosting company will announce the owner of the website about this problem and if doesn't not remove the stolen information, they will close his host, depends on the company.
    Good luck!

LOL, Is this happened to you first time. Can you believe , Mine 100 of websites have been copied in 1-2 year lol.

This is the part of game. Sometimes you meet with person who think who is smart lol. You can't make shit for him. Let say he uploaded his website to the offshore webhost. What you can do then? Nothing.

Get attach with things like that.

Another smart solution - DDOS his domain with thousands of IP's.
