My tube porn site received copyright infringement notices...

    My tube porn site received copyright infringement notices...

    That threaten they may take legal action if I do not remove the videos.

    These videos are ranking me nicely on google for certain keywords however though, what do you think, do I need to remove them?

    Will they really take legal action?

    Interested in some opinions, thanks.

    Yes, most of the time they will take action.

    Unless you are on bulletproof offshore hosting and using a domain
    registrar that is outside of US jurisdiction, then you can bet that the
    domain registrar and hosting company will also comply.

    Your best course of action is to remove the content and/or UPDATE
    the content to a different video. By updating to a new, uncopyrighted
    video you can still KEEP the rankings and the traffic and keep the
    powers at be happy.

    You should definitely remove the content. That is a huge liability by leaving those up. If you don't they could go directly to your host and just tell them to shut off your server then sue you. No income + lawsuit then what would you do?

    I would do what SuperLinks suggested and update the videos with new uncopyrighted stuff but still allowing you to keep the rankings and traffic.

    They can take legal action unless you've a fool proof system (as SuperLinks stated in above post). Porn industry is huge and they surely can throw large bucks for legal actions.

    Especially now more so than ever. With the shut down of many filesharing
    sites AND torrent sites like Cheggit (porn BT), they have more momentum
    then ever.

    Many of these filesharing sites and BT torrent sites have a tremendous
    amount of capital AND talent and yet they are shutting down like crazy.
    A smaller tube site is simply an ant in comparison, so don't get mixed
    up in legal trouble over something like this.

    I've read these types of threads before. You have a right to demand they prove that they actually own the copyrights on those videos. For all you know, your competitors realized the value these files had, and sent the email in order to scare you into removing them. Isn't there a certain protocol for copyright infringement takedown notices? Did they follow it? How certain are you the communication (email?) was legit?

    Can you post a copy of the message?

    Sounds like your running an illegal tube site. If it was legal you wouldn't have DCMA coming to you.

    I am glad you deleted the content but like someone else said only use legal content and you won't get any more take down notices.

    Illegal tube sites are what killed the adult affiliate industry. I just wish they bring down every illegal tube out there, so that porn starts selling again.

    I think the industry has changed so much that it will never go back to the way it was. We have to adopt to the new changes. I for one have stopped building anymore and just live off the residuals of what I have coming in. I am moving over to "Mainstream" to see what I can build here. Too many companies shaving their affiliates, muti level payment processing that dont pay once you past the first one...and so on.
