If the number of backlinks isn't an issue, I would try contacting the webmasters of the website where your backlinks are located and request to have them removed. If the backlinks are absolutely abhorrent, you can always use the disavow tool, but use it with caution as it can do more harm than good when used inappropriately.

    Sure you can do that.

    Deindex the site.

    Make sure it is deindexed.

Set up a new site with the content.

Not much to it really... I've done it several times with test sites.

Some people may care a lot about their domain name due to branding and would try anything to improve it. If you don't mind switching to a new domain name, then deindexing your website using Google Webmaster Tools, downloading your website's files along with its SQL database, and then switching it to a new domain name (which is a similar method often done with churn and burn websites) will be all you need to start over. Good luck with your endeavours!

This is not a viable option because the owners of the domains will not receive the emails. The sites are suspended sites as written in the OP.

You can certainly use the same design with different content. Using different content will prevent you from receiving a duplicate content penalty on your new or old website, so there shouldn't be any issues with cloning the site and changing the content.

Surely Google knows you're just switching domains if you transfer a ton of content to a new domain, deindexed domain or not?

When you get a penalty from a search engine, what is actually penalised is the domain name, not the content. If Google penalised content, then newbie Churn and Burners would have a much more difficult time ranking websites.

No it won't be easier to start over than to fix the problem.

If a majority of these crappy links don't even exist anymore than you are in a good boat to start. Finish the job and you can rank again. Starting over is for noobs.
