Monetizing a MacDonalds Sandwhich domain name

    Like the title says..the Golden arches just released a new sammmmich and the domain name was available...and its not trademarked....and its getting a good amount of searches...so I bought it.

    How would YOU monetize this domain? I dont want to park it. I wonder if Macdonalds has an affiliate program?

    Yeah I would either go with one of those mcdonalds vs burger king email submits. Or like previous mentioned a weight loss offer.

    As far as I know Mcdonald's doesn't have an affiliate program, and you are going to want to limit your interaction with them directly. Even though the domain isn't trademarked, they can still win a case against you and they have a lot more attorneys and resources to fit against you with.

    haha lmao...jsut had a nice idea for the weight loss approach....

    "SO, your fat ass is looking for an oversized double cheeseburger hey?"

    "Get with the program fatty and sign up for your Free weight loss trial and for god's sake, leave the fast food alone"


    ...then enter Jillian Michaels (from the biggest loser) weight loss affiliate program which pays $40 per sign up.

    Are you kidding? Companies trademark so much random shit I would be very hard-pressed to believe that McDonald's produces something that could affect revenue of 100+300 million dollars+ and not file a trademark.

    I have seen countless, countless, countless hilarious trademarks that companies put out every day just to save names for future use/thwart competition. The Patriots had 6 trademarks for their jersey change in 1995, and I think one looked like an effen superhero! I will have to find it and show it to you guys someday.

    The Devil Rays during their winning streak in 2007 bought about 4 trademarks they were going to use if they won the world series called 2007+1. They had all sorts of equations they were planning to sell through t-shirts and shit.

    Companies file trademarks for situations/slogans/campaigns they are .001% sure they will ever use.

    Even if for some odd reason they overlooked taking care of a name, a trademark doesn't have to be "filed" in order for it to be a legal mark for having rights over the mark. If the mark has made a permeated expansion into a market which is understood by others.

    Mcdonald's probably could care less, but they would own you if they took you to court. They have created the name and it has permeated through the market already through commercials that have hit millions of people. As well, if something happens to not be trademarked, capitalism has its own "pagerank".

    McDonalds has a seriously high "pagerank" in this instance due to their clout, so unlike the rest of us, they don't have to file for trademarks. A lot of it is general due diligence and business management, as well as making the process quick if a legal issue would come up.

    But this is a disclaimer to anyone squatting on names: if someone's name or product exist out in the market, and people can identify it, it can be pretty much defined as a trademark. You think the White Stripes trademarked their name when they came out? I bet you no other band could come out with a second White Stripes and expect to keep the name.

    There is a good amount of trademarking material on the web, but for multi-nationals, probably shouldn't showcase a site with their name or product on it.

    If I did have it, Combo diet/late-night product/submit offer medley. If Mcs comes after you, I would just act like I don't know anything and fool around until they make some offer. They wouldn't want to spend money to go to court either, so maybe you can say you made the site first, you named it after your friend's nickname ( which would identify longevity ), and you won't part with it unless you receive some compensation for the "work" you put into it.

    Seldom you get these companies trying to take your money, unless they use on case to teach people a "lesson". Since McDonalds is down in rev, they probably don't want to be poking at the common man for a PR push during this recession.

    IF they do not have a federal trademark on it as of your registration date your safe. Yes they can still drag you into court. Yes it will still cost you money. Most trademark cases are about making the person stop using the name. Proving damages is tough.

    Why not find some MacDonalds vouchers ( i know they hand out/post them or put them online sometimes) and hide the voucher behind a CPA offer?

    e.g. CPA-Lead style.

    You will be able to get away with it for a while unless it makes HUGE headlines and get a lot of media attention...... at least you have the Opportunity to make money now and capitalize on popularity.... I mean, the worst that can happen is they will send you a letter as a scare tactic , and when they do .....just stop and redirect it to main MD site!
