Legal? Why?

    Hello, i have been wondering for a while now how sites like this (warning adult content) hentairules . net and this fakku . net are able to stay up.

    Are they legal?

    Is it because they are using fan made content without copy rights attached to them?

    Are they able to use licensed material because they use an off shore server?

    Are other people allowed to use their content in the same way they use it because it is not their own?

    Sorry for all the questions i am new to and curious about copy rights and content rights.

    Not exactly. It seems the copyright owners just don' care. Japanese are very strange nation... They see he things a way different than europeans.

    Nope, they are pirates.

    P.S. There are 1000's of pirate sites over the Internet. Even YouTube has tons of stolen copyright-protected content on the board.

    Just one more thing about the last question/answer. So whoever uses stolen content first has copy-right ownership over it, and no one else can use the content such as images unless otherwise informed by the first person who stole it or else they'll get in trouble by that person?

    The copyright holder is the person/entity that first published it. Any others are merely pirating the material.

    So are the people from those blogs the pirates or the copy right holders? If they are the Pirates then can't i use the same material without being punished by them*?

    i tought that anime was ok to download and share cause people who draw anime do not pay taxes for their work, they cant sell them as a product(?) Something like that i have heard :)

    The owner of hentaidreaming, and myself had our index URLs removed as per DMCA request. Here's the DMCA in question:

    It isn't legal, and as long as you're not targetting the big keywords, like we both did (eg., "Watch Hentai Online" - had #1 spot, "Hentai" - had #3 spot, getting xx.xxx traffic per day, had my URL removed - huge drop in traffic. Cut it by about 80%), you'll be fine.

    Just have the server hosted offshore, as I had DMCAs all the time when the site was hosted in the US.

    Thanks daStick. So basically what 230 means is that no one can get in trouble for what their users post on their site? or am i wrong?

    If i'm right what i am wondering is if the bloggers from the sites i stated above are able to take legal action for anyone who takes the images and uses them in a similar fashion on ones own site?

    Basically if they're in the clear, and you then take the images from them, are you then also in the clear?

    My guess is no. But unless you get really popular, or are selling it, most people wont take the effort to go after you.
