[Legal or Illegal] Promoting offers as a brand named page

    Hi there,

    The title may be a little bit unclear, I'll explain it further here.

    So I started promoting Sweepstake offers and already getting a lot of leads.
    Though,
    I'm advertising these landing pages on Facebook and Twitter with the brand name the landing page is about.
    Example I'm using:
    - I'm promoting a Zalando sweepstake.
    - I'm using the name 'Zalando Panel' as advertiser name
    - The logo of Zalando is visible in the advertised image
    - I'm saying that Zalando gives away a certain item.

    On the image it says:
    - Zalando Logo
    - Zalando is celebrating their success!
    - Win free Nike Air Max 2017!

    Advertising as 'Zalando Panel'

    The description says:
    Zalando is celebrating their success in 2016! In 2016 the profit got up with 25%. We want to celebrate this with you! Click ob the url to win FREE Nike Air Max 2017 shoes!

    Is is legal or illegal to advertise like this? If it is illegal, what should I change in the ad above to make it legal?

    You're using their brand name, brand logo and their details without their permission ?

    Illegal for sure.

    From Zalando webpages: "The Zalando names and logos and all related names, design marks and slogans are the trade marks or service marks of us or our licensors."

    Though, last summer a lot of people where advertising fake Nutella sweepstakes and the only thing what happened is that Nutella posted on their page that these sweepstakes are fake. Nothing more. There is also copyright on their name and logo

    Well, you asked if it is legal or not. :)) It's up to Zalando's lawyers, how they decide if they found out what are you doing. However at the court in your position - no chance to win.

    Another question then, the landing pages itself are not made by me. these are made by other people who also abuse the companies name/logo. However, the creator of the landing page sends the info of people to other big Dutch companies like Lotto, VakantieVeilingen.nl & Postcode Loterij. How is that possible then?

    Anything is possible until you get caught. There is nobody here that can tell you when you will get a knock on your door. But what you are doing (and the others) is illegal. You should t worry what others do - you are the one that runs the risk of a personal claim against you. Some companies are strict and some are slow. But if they want to protect their identity and products you are at risk. No different to me asking how my neighbour gets away with speeding... who cares, I'm not him.
