Legal Notice from AC

hi guys,
My friend got a legal notice from AC yesterday. He forwarded me the mail.

Here is the message:

"It has come to our attention that you have been publishing stolen content under several AC accounts.

We have permanently banned your account on Associated Content, as well as any affiliated accounts.

Any of your submissions for which we offered payment, but have yet to send payment, have been removed from our website. We have rescinded these offers and cancelled the pending payments.

Additionally, we will be reviewing the content you submitted that was published on Associated Content to see if any of it violated copyright laws. You agreed to indemnify AC for any financial damages it incurs because of your breach of section 7 of the Master License Agreement. Accordingly, in the event that AC is sued because of your violation of a third party?s intellectual property rights, please be advised that we will look to you to recoup any of these financial damages, including?but not limited to?any attorney's fees incurred defending the action.

If you open another account(s) in the future, it will be closed automatically without notice. If you continue to open accounts and use aliases on PayPal, we will file a formal complaint with PayPal, which could ban you and any affiliated accounts you may have with their services as well.

I dunno what to say him. Should he quit doing AC or he can continue. Can he really be sued? He is worried.

AC accepts articles after reviewing its genuineness. That means they check internet using their tools for similar or copies. So they checked, found article is good, then initiated payment, then why the hell they canceled the pending payments?

Whatever, they really got headache with your friends articles.
How many articles he was submitting and how many accounts he have?

Dont worry about the legal issue.. AC need to prove those articles are not unique...

Conclusion: Those smart people quit AC long time ago and moved to other things.
If you want pennies and low respect for your hard work, stick with AC..
 
He can definitely be sued for this. Violation of copyright is a serious thing. It really depends on the extent which he did it. Many people do not want to fuss with the litigation.

I agree with you, they could do it.
 
Now he closed all his accounts. Paypal, email everything. Can he be tracked still? After that notice he did not do AC.

I think this notice was sent to stop him from doing AC. As long as he stops doing AC and creating multiple accounts he wont be sued. I dun think AC can take legal action on a person who is not in their jurisdiction. All they can do is Ban him from participation. But I dunno clearly about that.

Require more suggestions.

I don't really get why people stick to AC. It's hard to submit articles and it's low paying. Why don't they just build a blog? Yeah, it would take time to earn as much, but in the long run it becomes more profitable than AC.
 
Any suggestions? Is my friend safe? If he quits AC. Is this an empty threat to stop him from doing AC?

ya, 100% safe.. do not touch AC again with original personal info. If he want to use AC again, get new IP, new writing style, new paypal (because he closed his paypal in fear)..
 
do yourself a favor and move on to other things....
 
I gave up AC long time ago. I told my friend to give up as well. He gave up now but he is worried about the notice though. So AC cant sue him if he stops doing AC with same info again?
 
Its only a matter of months before AC as an income method is declared dead on this forum. I can't wait. I also can't wait to see all those arrogant forum trolls on AC when they realize they are getting like a dollar or two for an hours work.

My question to the OP is how did he get copyrighted material submitted to AC. If you are going for upfront payments, they check every article for uniqueness and would have rejected them.

If he submitted under display rights only, duplicate content is fine so long as he has full rights to it. if he just scraped some stuff off the net and submitted it, then he could be in trouble.
 
He says he copied contents from constant-content.com. He rewrite few and copied few so thats where he got the contents from.

And it also says, if AC is sued they the problem comes. They cant be sued bcs they ban both contents and accounts if someone claims that its their content. So I dont see too much problems. But let me keep u guys posted.

Is more like a C & D cease and desist letter.

Just stop for a wile and cover your tracks, they do can take legal action but like most american Co. they will stop if they see that the C & D was successful, legal pursuit cost money to them a C & D letter oly a few minutes to send and or a stamp.
 
thnx menthor and this letter came last month my friend checked his email only yesterday and it has been a month so I dun think any action will be taken as long as he stops doing AC.
 
AC can and will follow up with legal actions. It just depends on how big their boner for you is today. I know of a couple of guys who got more than just a C&D. AC filed suit in court and they got summoned. I don't know if the cases got pressed to the end or if they settled out of court, but it was def more than C&D. Didn't you ever wonder why the OP of a certain other thread in this forum suddenly stop offering help and their e-book is no longer for sale?

Why not use AC for the (low) upfront cash it pays, while you are building your blogs? It's not an either/or. Many businesses have multiple profit centers to get them quick money now, while building for big money later. That was/is the real value of AC, it de-facto can be paying you as you build your long term empire.

The man violated two sites policies, AC and CC.
If AC contact CC, then it will become bad thing.

CC authors are selling articles there..
So violated AC, CC and individual authors rights...

Hope he will not get much problem..
 
If first offense and first C&D then don't worry. They won't chase him. Just don't sign up another account and don't even visit the damn place. Move on - bridge burned - lesson learned. Now learn something new that works better.
