Legal issues for Brandname in domain?

    Hi guys,

    i wanted to know if there are legal problems - when I buy a domainname like nokian92unlock.com ?

    Like you can assume i want to offer a unlock service for n0kia phones.

    You might be ok for a while but if they find your site and want to take it... its theirs. I keep brand names out of my domains specifically for that reason.

    They would probably just seize the domain rather then pursue legal action.

    i will use the bhw hosting service - to be as much "anoynm" as possible.

    Ultimately what it comes down to, is not whether you are actually infringing their trademark because the issue is that there is a question as to whether you are infringing their trademark (meaning they could initiate a legal proceeding against you). Even if you were not infringing in any way on their trademark, the corporation could literally put your site out of by business by filing a lawsuit (because it would cost a lot to fight such a lawsuit). Many times it is just easier to take the site down.

    Your choice of using offshore hosting is a good start to avoiding problems, but like I said above, its pretty easy for them to file a lawsuit, even if there is no substance to their case.

    If you're worried go with offshore hosting and registrar and privacy on. This will stall any legal issues you might have. Takes a lot longer to find you that way.

    Like was mentioned above it may not be an issue if you aren't trying to infringe on the product. If you're an info site about the unlocking the phone you probably won't run into as many issues.

    Why don't you go more general like unlockcellphone.com or something and make a big site about unlocking all sorts of phones?

    They usually don't care. The only reason they would probably take action is if your site got huge. If it is a micro-niche site, you should be good to go.

    I always play it safe well kinda..... Just brought a domain get___.com and will see if I get sued it's a major tv network channel but they also offer an affiliate program so if I sign up to be an affiliate and am excepted can I then legally use there name since I am selling there stuff for them. If any 1 knows the answer to this question that would be super helpful.

    I have had this happen to me once. I found a major university that didn't register the .net domain....and then marketed the heck out of it. 4 weeks and 300,000 visits later, I received a call from their lawyer and from Godaddy :p

    I have this issue right now!! I have got a brand name in my domain promoting their
    products using pictures from amazon - Lawyer want me to transfer the domain and
    take down all copyrighted pictures... like a idiot I have the domain regester to my name
    and address... From now on all my domains will be regester to someone in Jamacia.

    They will size it but ask them to buy it. I was negotiating those and could have $30 or $40 for them. But yes, they will ask you to let it go...
