Legal action threatened...

    I got micro niche key words, registered them as a domain .net. There´s a medical company with the same name, they are .com
    The wp blog is only up 2 days with 2 articles about what it is they do... nothing derogatory, i´m not asking for money or anything... just have adsense. I got a call from the .com company today asking me to take down the site immediately or face legal action...!!! They called my home number, which is ex directory... have no idea how they got it. I put my cell number on any registration form and that doesn't show on whois... anyway, will make names private from now on... but the question is, have they any grounds to claim copyright infringement? Or any legal action? I really am not up for the legal hassle and would prefer to take it down... but just to piss the guy off I said I would have to see where I stand legally before I would consider taking it down.

    if you're using their trademarked company name, they can certainly sue you.

    That was going to be my first question!! Is the name a registered trademark? If so, then it's really not worth the hassle.

    i dont think so check who has mj.com registered check who has hitler.com registered are they big as google if not why worry i am not much into legal issues but why not ask your registration site to help you. Tell them you wish to get site registered for another 5 years they will surely guide you. Change ur phone number some friend of yours might have leaked the info

    I was under the impression you could use words if people that visit your site don't mistake them for the trademarked company.

    For example, there's a store near me called "urban farm" but I dont think they could take my urbanfarm.org site if I dont have anything to do with their business. microsoft.org would be a different story, even if you are selling toilet paper :)

    I don´t know if the name of the company is a registered trademark... how do I find out? They found the site in less than 2 days! Wow! If they were that protective, they should have registered .net .org etc

    if they are a global company, then yeah, u will get sued.

    they were founded in the USA... now they operate in the UK and Ireland as well.

    Was it the number ending in 2172? Anyway - your bluff is called. It could get expensive. You should decide your next step very carefully - and in fac tyou should consider consel wiser than bhw.

    Holy cow! Yes, the number ending in 2172... how did you get this? please pm me... I´ll remove it anyway... I actually paid someone to find the key words and do the blogs, I barely even remembered the name registered when the guy talked to me on the phone... was just curious about legal ground... but how did you get that number??!

    60 seconds on Google. Seriously, if I can do that, then the professionals can be expected to have you cold (I also found -2923, but that's your Da, right?). All I can say is consider the risks, consider the likelihood of losing multiplied by the cost of losing (classic risk assessment), then consider if you want to keep playing this game. (note- it was NOT me who called ;-) )

    don´t know who 2923 is... Its not like I´m a criminal... I have several sites, nothing to hide. I tried to find it on google but couldnt... can u please pm me and tell me what you looked for? Maybe I can fix it... see where the leak is so to speak.
