Can this site > http://down.cd/ < legally charge people for download copies of the progams. In their terms and conditions it says that the downloader must own an original copy and is downloading their copy as a backup. Everybody in their right mind knows any downloader did not legally own an original copy. My question to you guys is do you think that they can legally do this?

    Thanks

LOL !!! I used to work for (random computer software company). It was funny as hell to get support calls from people who downloaded their products from similar places to that.
Of course, can't give them support on those.

And, of course, (random software company) was always looking for some possible way to shut them down, but were powerless to.

No , it's illegal in the USA. That's considered criminal copyright infringement. That's why it's hosted in russia.

So, could I run a site like this as long as the hosting is out of the country?
    Me living in the U.S.
Hell, you could even take software requests and charge extra for that.

If someone in the U.S. was trying to set something like this up is what could be done to protect oneself from copyright laws and the such.

Would it even be worth the risk.

It would be like being a middle man between the torrent networks and users to stupid to know how to use torrent networks. I like it.

Actually, it is not as "illegal" as you may think. Check out:
    Code:
    http://www4.law.cornell.edu/uscode/html/uscode17/usc_sec_17_00000117----000-.html
You are allowed to make/have made/own backup copies of your media that you purchase, whether it be software, movies, etc... as long as you own the original and want to keep it safe.

You are legally obligated to obey the laws of your country, regardless of where your hosting is. Also, there is far more to just hosting you need to worry about with a full blown e-commerce business.

I'm starting to notice a sad trend of people thinking they can operate a full blown illegal business without legal trouble by having a store with an IP address somewhere else, it's not that simple.

yeP YOU ARE CORRECT. All a oversea Ip will do is keep the website from getting canned.

But you still have to worry about merchant account, address, bank accounts etc.

But I dont order from the site anymore. Everything they offer is free on the net at www.katz.cd

nowadays you can get anything you want through torrents thats why I find it hard to believe people actually order things through them.

Being objecive about it...yeah u could, but maaaan unless u actually live in that country to run the site I wouldn't do it, because some way some how ...the FEDS is going to find there way into the game...especially if your making alot of money, and when the FEDS get involved loyalty is limited. Remember that!

Katz.cd does not host any files... so AVG is picking up their monetization sites. All they do is refer you to sites that give links to files, usually on Rapidshare.
