I just did this. I think you'll be find as long as your not incentivizing clicks.

I'm fairly certain that its considered "tricky" since he's attempting to trick visitors into clicking those links by imitating a menu bar.

I'm also fairly certain that its in their TOS that you can't do this. Then again, I believe that there's a rule that allows Google to terminate Adsense relationship at their own discretion as well.

Chances are he'll be fine unless his traffic doesn't convert.

Sorry for not understanding your comment but did you mean that CTR from this place is low?

Well, I personally believe it is very risky. Because, basic users of internet will think it goes about internal pages of your website when clicking on it. And this is against Adsense policy...

I think is valid, or should be, I mean, it's not considered to be a menu bar, I has an "Ads by Google" sign on it for something.

That's why "Ads by Google" comes first. ;)

There's no AdSense policy against stupid surfers. Thus the "Ads by Google" link. :D

Placing an ad/link block in a prominent place doesn't trick users into clicking.

If all webmasters jumped off a bridge, would ... Oh, nevermind. :D

Trying to imitate a menu bar is valid. Google doesn't have any policy regarding that type of placement.
The only problem I see is that your ad is under a title "SEO TIPS AND TRICKS". I can see google having problems with that. There is a google policy that prevents you from doing that. It really depends, it needs to be manually reviewed. Some ads under the title are ok or allowed and some are not.

as it's a 728x15 ads there is no problem because even if people click it , it just bring them to another page with ads so you don't get money unless they click an ad on this other page.

Looks fine to me. Whos being tricked? If a person doesnt know what an advertisement is, they are going to click no matter what.
