So I think I already know the answer, but thought I'd ask you all anyhows.

I've been told to tread a bit lightly on one of my existing domains. I won't give it away, but I'll be the first to admit its a bit close to the edge of copyright infringement.

But moving on . . . I don't want to make another mistake again. So here's the question:

What's the legal implication of registering a domain such as:

wwwDot "Buy (Brand Name/Famous Product)" Dotcom

Apologies if this thread sounds a bit dumb, but would love any clarity you may have

You'll be fine as long as you aren't negatively representing the product, usually. If you get an email from somebody claiming to be the copyright holders don't respond and simply drop the domain. They lose money pursuing you in court and usually want you to transfer them the domain. Just drop the domain and ignore the issue.

I have domains including all kinds of the biggest companies and products out there. Never once been contacted about it by a copyright holder.

    Thanks IH

That's kinda what I was hoping. Afterall, using the "Buy" before the brand name can only be a good thing if the intention is to promote that name/product.

Another question. Do you think a domain like this carries any SEO weight?

Well some people are saying that EMD (exact match domains) have lost value in the Panda update. So it depends. Personally, having the keyword in the domain whether EMD or just containing it will give you a slight edge if not a somewhat significant one.

So yes, definitely worth putting the brand name in the URL.

This is completely false is almost every circumstance. The company has spent money building their brand and most likely owns the trademark. If you use the trademark in a domain name, you're infringing on their intellectual property and they have a right to take the domain from you.

In the cases I've dealt with, they usually just want the domain and you can amicably resolve the issue by transferring the domain to them.

I'm not a lawyer and this is just my opinion based on my experiences.

My statement is not completely false. Generally you are going to be okay. I'm not saying they don't have a right to take it regardless of what you're doing, I'm saying generally they will not waste their time unless you are negatively representing their brand.

And from my experiences of over 100 domains with Copyright brand names in them, I've never had an issue. My partner who also has a similar number of domains like this is about 2/100. So it really depends on whose brand name you take.

Interested on this too. I read about people ranking product+review without problems, at least for the first months. But not sure if going stealth depends on traffic obtained. Ranking above the brand for important keywords where they are high in serps could be a trigger.

On the other hand I see domains registered for years with brand+product, but most of them parked or with no content. May be better not to build anything and speculate with domain name?

One time i got a big brand name domain in one country and nobody contacted me in one year. The bigger issue could be building something and after ranking deciding between giving the name for free or try defend with possible legal consequences.

Do you think private contact info is important here? Publishing contact info and admin of website... god or bad?
