I have a MNS that has been sitting at #3 for awhile now. The first 2 spots are the products official sites.

Is there any danger in getting it to #1 ? I have just part of the name of the product in my url.

    Thanks in advance.

If its trademarked, you may have some annoyances/trouble...if its some giant company...like Walmart or something, I'm guessing they got the money to win regardless of whos right.

If I were the company that you outranked it would def not be ok with that. I would look at your backlinking profile and I am 99,9% sure that I would find spammy backlinks + bought links. I would then proceed to file a spam report to Google that you have shady backlinks. Google will then ask you to remove those backlinks. You will then get moved from the 1st page of google.

And we all know that the best place to hide a dead body is at the second page of google.

You generally won't outrank them - 99.9999% of the time. You can try, but G is good at spotting official pages and generally speaking their clickthrough will be a lot higher and bounce rate a lot lower because people searching on the brand name will recognize the official site - this also makes their site a winner as far as G is concerned. If you're their affiliate, you might hear something about it - so if that's the case be careful that you're not jeopardizing your relationship as the rankings are no good if you lose your monetization. However, they can only UDRP your domain if it contains a trademarked term or term that is "confusingly similar".

I suggest you start augmenting your site traffic with other related keywords. Even if the company don't care, one day they might. This happened in ppc already where at first merchants allow you to bid for trademarked keywords but now disallow it.

If your only source of traffic is trademarked keywords, you are doomed. Remember they can change the terms any time. Merchants want you to drive them traffic, but soon they'll ask you to do so from sources where they can't easily dominate.
