Is it legal for an employer to make the server pay for credit card fees on his/her tables?

    I simply began at a neighborhood mexican restaurant and revealed that I am answerable for the charge card expenses when a client pays with a credit or check card. is this even legitimate? I just make 2.13 a hour as it seems to be, and if a client pays with a card and doesn't tip me, I wind up paying right to hold up their table!

    THAT is bulls*it in every way. Not sure about the legalities of it though. I know years ago when I tended bar that the owner used to make us make sure the till was zeroed out using our tips.

    I did F&B for over 10 years before switching to IM full-time. That's some shady business. Even if it's legal (could depend on state), that is not a place you want to be working. I've worked in many a establishment starting from the worst breakfast shit hole, ending up bar-tending at some of the finest resort hotel cocktail bars, and no where in my 10+ years has any establishment mandated that the staff be responsible for covering the CC transaction costs. If you need the job (I know how it is) keep working there, but start applying everywhere else you can. People like that will f#ck you big time. Keep track of all your hours and tips, because there's a very big chance they're ripping you off there also. Good luck.

    I also was in Food and Beverage most of my life in management. Never once did I charge the servers for credit card fees. I have to think that this is illegal but check and see, most of all GTF out of there as soon as you land another job!

    It makes me sick to know there is a business out there operating this way. For the most part food-service is a thankless job with shitty hours since you have to work when everyone else is off (weekends, nights, holidays etc..) and to know that someone is charging their employees for this type of thing is just wrong.

    it should be illegal especially if you are gettiong 2 dollars, that is their expense. I would tell him since I am paying for your expense, I should get some of your profit.
