Is it illegal to recreate an expired domain from the archive?

    Not that BHW probably cares about whether or not something is illegal, but hypothetically speaking, could you get in trouble? You're basically copying someone else's content.

    I guess it could be considered copyright infringement in the US.

    There's a bit of a risk involved, but it's rare as well. It may happen in a situation, when the domain owner lost it mistakenly and would want to use the same content for his new domain and finds a copy of it.

    Yes, it is against the law, but as guys suggested, if domain was left to rotter, then there is a high chance of probability that owner doesn't care so much...until you make some money that is.
