Is Dynamic Text Insertion IN Google Adwords Ad Text Alllowed? Or Trademark Infringement?

    Hi Fellas,

    I was using Dynamic text Insertion in my Ad Text In Adwords from last 4 months and my ads were showing Trademarks at the Title Line. Now i kinda heard that this is Trademark Infringement! Is it true? Should i continue using it or discontinue doing it? I am stuck. Need an answer!

    If the Trademark owner files a complaint with Google, they may disapprove your ads or only allow them to appear in certain circumstances. Whether they will do that depends on the size of the company, if you're trying to misrepresent yourself as them, etc.

    However you haven't said how you're using these ads. Are you an authorised reseller of their products or providing an informational service about their products to visitors? No trademark owner is going to have a problem if you are selling their products and are authorised to do so (read: you're not selling fake merchandise)

    I think you should take some time and read the Trademark Policy (Google it, I can't post links yet).

    Or give us some more information about how you're using the Trademark in the ad :)

    If you used a trademark without authorization then it's a trademark infringement.

    Exactly. Google doesn't allow using trademark in adtext or description. You can use them as keywords.


    On the other hand as long as the brand owner does not complain you are fine with it.

    Are you kidding me! I think everyone is here just to increase their number of posts. Don't spam this thread For God Sake! I asked about Dynamic Text Insertion!!! Even a kid knows about Trademark policy of Google Adwords.

    Clearly you don't, because it's one and the same.

    If you are using a DKI such as {KeyWord:Trademark Term}, then when a users search string is too long to fit in your ad, the trademark term will be displayed.

    Unless you have authorisation to use this trademark, for example you are a reseller or have direct permission from the trademark owner to do so, it is trademark infringment.

    your major problem is not with Adwords (they dont care as long they dont get complaints from TM owners), but with the TM owner. They can:
    1. file a complaint to Adwords - worse case, they wont approve your ads
    2. file a personal law suit against you - then, you're in trouble.
